                                     AN ACT

     1  Amending the act of March 10, 1949 (P.L.30, No.14), entitled "An
     2     act relating to the public school system, including certain
     3     provisions applicable as well to private and parochial
     4     schools; amending, revising, consolidating and changing the
     5     laws relating thereto," requiring full State funding for all
     6     mandated State educational programs and activities.

     7     The General Assembly of the Commonwealth of Pennsylvania
     8  hereby enacts as follows:
     9     Section 1.  The act of March 10, 1949 (P.L.30, No.14), known
    10  as the "Public School Code of 1949," is amended by adding a
    11  section to read:
    12     Section 2554.  State Funding for State Mandated Educational
    13  Programs and Activities.--(a)  No school district shall be
    14  required to develop, implement, and administer any new State
    15  mandated educational program or State mandated educational
    16  activity until such time as the school district shall receive
    17  from the Commonwealth of Pennsylvania the full amount of money
    18  necessary to develop, implement and administer the State
    19  mandated program or activity.
    20     (b)  For purposes of this section the term:


     1     (1)  "Full amount of money" means money from the General Fund
     2  which is appropriated in an amount sufficient to cover all costs
     3  involved in the development, implementation and administration
     4  of any State mandated program or activity. Such moneys shall be
     5  in addition to any other moneys the district is entitled to.
     6     (2)  "State mandated program or activity" means any program
     7  or activity which is imposed without choice on all or a portion
     8  of all local school districts by acts of the General Assembly or
     9  by regulations and policies of the Department of Education.
    10     Section 2.  This act shall take effect in 60 days and shall
    11  apply to all programs mandated after the effective date of this
    12  act.
