AN ACT 1 Amending the act of June 13, 1967 (P.L.31, No.21), entitled "An 2 act to consolidate, editorially revise, and codify the public 3 welfare laws of the Commonwealth," providing for equal rights 4 for males and females and making an editorial correction. 5 The General Assembly of the Commonwealth of Pennsylvania 6 hereby enacts as follows: 7 Section 1. Sections 351, 352 and 353, act of June 13, 1967 8 (P.L.31, No.21), known as the "Public Welfare Code," are amended 9 to read: 10 Section 351. Purpose.--It is hereby declared to be the 11 legislative intent to promote the welfare of this Commonwealth 12 by making available facilities for the rehabilitation, 13 reeducation, treatment and training of [male youth] young 14 persons. 15 Section 352. Facilities.--The Department of [Forests and 16 Waters] Environmental Resources, at the request of the
1 department shall provide and maintain facilities to be used for 2 forest conservation and for the education and training of [male 3 youth] young persons. In cooperation with the Fish Commission 4 and with the Game Commission, the Department of [Forests and 5 Waters] Environmental Resources shall plan useful projects for 6 conservation, recreation, dams or flood control in State forests 7 and State park lands, and shall supply personnel to supervise 8 work on these projects. 9 Section 353. Selection, Acceptance and Return of Campers; 10 Commitment Order.--The department may select as campers young 11 [men] persons fifteen to eighteen years of age, who have been 12 committed to any youth development center or whose commitment as 13 campers is recommended by a classification and assignment center 14 of the department and whose rehabilitation will be furthered by 15 forestry work. 16 The department may also accept as campers, [boys] persons, 17 fifteen to eighteen years of age, who have been committed to an 18 institution and whose transfer to a camp is recommended by the 19 institution and approved by the committing juvenile court. The 20 department may return campers to the institution from which they 21 were received for reasons of health, security or morale. The 22 committing juvenile court shall be notified promptly of such 23 action and a full explanation in writing shall be provided the 24 committing court and the institution. No forestry camp shall 25 receive a [boy] person as a camper unless an order of commitment 26 accompanies him. When a [boy] person is transferred from a 27 forestry camp to an institution, the order of commitment shall 28 accompany him. 29 Section 2. Paragraph (5), (6) and (7) of subsection (a) of 30 section 405.1 of the act, added July 15, 1976 (P.L.993, No.202), 19780H2226B3788 - 2 -
1 are amended to read: 2 Section 405.1. Pennsylvania Employables Program.--(a) Every 3 individual, within ten days after establishing eligibility for 4 public assistance, as a condition of continuing eligibility for 5 aid to families with dependent children or general assistance, 6 shall register in accordance with regulations of the department 7 for employment, training and manpower services, unless such 8 individual is: 9 * * * 10 (5) the [mother or other relative] primary caretaker of a 11 child under the age of six [who is caring for the child]; 12 (6) the [mother or other] primary caretaker of a child if 13 [the father or another] another adult [male] relative WHO IS THE <-- 14 PRINCIPAL WAGE EARNER is in the home and not excluded from the 15 requirement to register, unless such adult [male] relative has 16 failed to register as herein required or has refused without 17 good cause to accept employment or to participate in work 18 experience or training; 19 (7) the [mother or other] primary caretaker of a child 20 between the ages of six and fourteen, unless there are adequate 21 child care arrangements for the child; 22 * * * 23 Section 3. Sections 1142 and 1145 of the act, are amended to 24 read: 25 Section 1142. Purpose.--It shall be the purpose of the 26 foundation to support, encourage and finance research of every 27 nature and description in the field of mental health including 28 all aspects thereof or related thereto and to train [men] 29 persons in the field of mental health including all aspects 30 thereof or related thereto. 19780H2226B3788 - 3 -
1 Section 1145. Research Advisory Committee.--The secretary
2 shall appoint a Research Advisory Committee of nine members, one
3 of whom shall be the Commissioner of Mental Health, who shall be
4 its chairman. In appointing such committee, the secretary shall
5 select one representative from each of the following six medical
6 schools, colleges or mental institutions having an active
7 research department: The School of Medicine of Temple
8 University, the School of Medicine of the University of
9 Pennsylvania, the Pennsylvania State University, the School of
10 Medicine of the University of Pittsburgh, the Eastern
11 Pennsylvania Psychiatric Institute and Carnegie Institute of
12 Technology. The Research Advisory Committee, subject to approval
13 of the board, shall choose and supervise the projects to be
14 undertaken by the foundation. The members of the Research
15 Advisory Committee shall not be entitled to any compensation for
16 their services as members but shall be entitled to reimbursement
17 for all necessary expenses incurred in connection with the
18 performance of their duties as members. The programs of research
19 and of training [men] persons in the field of mental health
20 shall be carried out only in Commonwealth institutions under the
21 jurisdiction of the department. This section shall not be
22 construed to prevent ancillary research or training outside of
23 these institutions so long as the primary program in connection
24 with which the ancillary research or training is undertaken is
25 conducted within a Commonwealth institution.
26 Section 4. This act shall take effect in 60 days.
