                                     AN ACT

     1  Amending the act of July 31, 1968 (P.L.788, No.241), entitled
     2     "An act providing for the planning and regulation of solid
     3     waste storage, collection, transportation, processing and
     4     disposal systems; requiring municipalities to submit plans
     5     for solid waste management systems in their jurisdiction;
     6     authorizing grants to municipalities; requiring permits for
     7     operating processing or disposal systems; imposing duties on
     8     and granting powers to municipalities; authorizing the
     9     Department of Health to adopt rules, regulations, standards
    10     and procedures; creating an advisory committee; providing
    11     remedies, prescribing penalties, and making an
    12     appropriation," further providing for the regulation of the
    13     disposal of solid waste in mines.

    14     The General Assembly of the Commonwealth of Pennsylvania
    15  hereby enacts as follows:
    16     Section 1.  Subsection (g) of section 7.1, act of July 31,
    17  1968 (P.L.788, No.241), known as the "Pennsylvania Solid Waste
    18  Management Act," added January 12, 1970 (1969 P.L.456, No.187),
    19  is amended to read:
    20     Section 7.1.  Additional Requirements Affecting Disposal in
    21  Mines and Transportation of Solid Waste for Such Purpose.--* * *
    22     (g)  No permit for dumping or depositing of any solid wastes
    23  into any mine shall be issued without the approval of the board

     1  of county commissioners of the county in which such mine is
     2  located. The board of county commissioners may condition its
     3  approval by prohibiting the dumping or depositing of any solid
     4  waste originating outside the county which prohibition shall be
     5  made a condition of the permit issued by the department.
     6     Section 2.  This act shall take effect in 60 days.
