        AS REPORTED FROM COMMITTEE ON STATE GOVERNMENT, HOUSE OF
           REPRESENTATIVES, AS AMENDED, SEPTEMBER 26, 1977

                                     AN ACT

     1  Authorizing the Department of General Services, with the
     2     approval of the Governor, the Department of Public Welfare
     3     and the General State Authority, to sell and convey certain
     4     land and its buildings thereon located in the borough of
     5     Blossburg, County of Tioga to North Penn Comprehensive Health
     6     Services, Inc., and making appropriations.

     7     The General Assembly of the Commonwealth of Pennsylvania
     8  hereby enacts as follows:
     9     Section 1.  The Department of General Services, with the
    10  approval of the Governor, the Department of Welfare and the
    11  General State Authority, is hereby authorized on behalf of the
    12  Commonwealth of Pennsylvania, to sell and convey, to North Penn
    13  Comprehensive Health Services, Inc. for the sum of $1, the
    14  following described tract of land with the 6 buildings thereon
    15  situate in the Borough of Blossburg, County of Tioga and
    16  Commonwealth of Pennsylvania, consisting of 8.55 acres together
    17  with a lot (Lot No.3-Block 14 of plot of Blossburg) being ninety
    18  (90) feet in width fronting on the southerly side of Granger
    19  Street and having a uniform depth of one hundred (100) feet,


     1  bounded and described as follows:
     2     BEGINNING at a buried post marking the southwesterly corner
     3  of subject land on the easterly side of Ruah Street; thence,
     4  north 72 1/2 degrees east 637 feet along the northerly line of
     5  land now or formerly the land of the John Miller estate to a
     6  point on the southerly line of Granger Street; thence, along the
     7  southerly line of Granger Street north 43 degrees west 283 feet,
     8  more or less, to a point marking the northeasterly corner of
     9  land now or formerly of Estella Backer; thence, along southerly
    10  line of Backer south 48 degrees west 200 feet to a point and
    11  other land of the Commonwealth; thence, north 42 degrees west
    12  243 feet along westerly line of Backer to a point; thence,
    13  continuing along westerly line of Backer north 43 degrees west
    14  132 feet to a point and other land of the Commonwealth; thence
    15  north 46 degrees east along other land of the Commonwealth 200
    16  feet to a point marking the westerly line of Granger Street;
    17  thence, along the westerly line of Granger Street north 44
    18  degrees west 90 feet to a point on the westerly line on Granger
    19  Street marking the southeasterly line of land now or formerly of
    20  Johanna Haley; thence, south 46 degrees west along said Haley
    21  land 100 feet to other land of the Commonwealth; thence, north
    22  44 degrees west 205 feet along said Haley land to a point making
    23  the northeasterly corner of the land herein described; thence,
    24  south 40 minutes west 425 feet along land now or formerly of
    25  Joseph Hughes; thence, south 32 degrees east 343 feet along
    26  Railroad Street to a point; thence, continuing along Railroad
    27  Street south 27 degrees east 400 feet to the buried post and
    28  place of beginning, containing a total of 8.55 acres plus a lot,
    29  said acreage consisting of a plot of 3.55 acres plus a plot of 5
    30  acres and lot 90 feet by 100 feet. Being the same land conveyed

     1  to the Commonwealth as shown in deeds lodged in Land Office Vol.
     2  N-2, dated August 12, 1889, and Vol. N-1 and 2, dated June 27,
     3  1916.
     4     The seller further conveys to the buyer the right of egress
     5  and ingress to the premises from Granger Street and Ruah Street.
     6     Together with six (6) buildings erected thereon, designated
     7  as follows: Building 32, Building 38, Building 50, Laundry,
     8  Boiler Plant & Garage and the Old Nurses' Home.
     9     Together with all fixtures attached to the buildings or
    10  realty, all machinery and equipment installed on located on the
    11  premises, and all personal property situate in the said
    12  buildings, to be determined by a physical inventory of all
    13  machinery and personal equipment to be conducted on the date
    14  that the buyer takes possession of said premises.
    15     The conveyance shall be made under and subject to all
    16  easements, servitudes and rights of others, including but not
    17  confined to streets, roadways and rights of any telephone,
    18  telegraph, water, electric, sewer, gas or pipeline companies, as
    19  well as under and subject to any interest estates, or tenancies
    20  vested in third persons, whether or not appearing of record, for
    21  any portion of the land or improvements erected thereon.
    22     Section 2.  The deed of conveyance shall contain a clause
    23  that the lands conveyed shall be used for the purposes of
    24  providing health care services, and all related services
    25  thereto, for the benefit of the people of the counties of
    26  Bradford, Sullivan, Susquehanna, Tioga and Wyoming and such
    27  other people as need shall determine by North Penn Comprehensive
    28  Health Services, Inc. and if at any time the said corporation or
    29  its successor in function conveys said property or authorizes or
    30  permits said property to be used for any purpose other than

     1  health care services or related services thereto, the title to
     2  such land shall immediately revert to and revest in the
     3  Commonwealth of Pennsylvania.
     4     Section 3.  The deed of conveyance shall be approved by the
     5  Department of Justice and shall be executed by the Secretary of
     6  General Services in the name of the Commonwealth of
     7  Pennsylvania.
     8     Section 4.  (a)  The sum of $329,000 or as much THEREOF as     <--
     9  may be necessary is specifically appropriated to the Department
    10  of Public Welfare for payment to the North Penn Comprehensive
    11  Health Services, Inc. to renovate the conveyed premises to meet
    12  all standards of the Department of Labor and Industry.
    13     (b)  The sum of $271,023.19 is specifically appropriated to
    14  the General State Authority to satisfy any outstanding bonded
    15  indebtedness which is secured by the conveyed premises.
    16     Section 5.  This act shall take effect immediately.
