AN ACT 1 Creating the Pennsylvania Intergovernmental Council providing 2 for structure, membership, powers and duties; establishing a 3 form of compensation and defining terms. 4 The General Assembly of the Commonwealth of Pennsylvania 5 hereby enacts as follows: 6 Section 1. Short title. 7 This act shall be known and may be cited as the "Pennsylvania 8 Intergovernmental Council Act. 9 Section 2. Definitions. 10 The following words and phrases when used in this act shall 11 have, unless the context clearly indicates otherwise, the 12 meanings given to them in this section: 13 "Council." The Pennsylvania Intergovernmental Council. 14 "Federal Regional Council." The Regional Directors for 15 Federal Region III of the major grant making Federal agencies 16 whose chairman is appointed by the President. 17 "Statewide associations of general purpose government." The 18 Pennsylvania League of Cities, the Pennsylvania State
1 Association of Boroughs, the Pennsylvania State Association of 2 County Commissioners, the Pennsylvania State Association of 3 Township Supervisors and the Pennsylvania State Association of 4 Township Commissioners. 5 Section 3. Structure and membership. 6 There is hereby created a Pennsylvania Intergovernmental 7 Council which shall consist of 13 members including the 8 Governor, Majority Leader of the Senate, the Minority Leader of 9 the Senate, the Majority Leader of the House, the Minority 10 Leader of the House, the Secretary of the Department of 11 Community Affairs, the presidents of each of the five Statewide 12 associations of general purpose governments, the chairman of the 13 Mid-Atlantic Federal Regional Council and one appointee of the 14 chairman who is a member of such Federal Regional Council. The 15 Governor may designate the Lieutenant Governor or another 16 cabinet-level appointee to serve in his stead as a permanent 17 member of the council. The Majority and Minority Leaders of the 18 General Assembly and the presidents of the Statewide 19 associations of general governments may each appoint another 20 elected official to serve in their stead. 21 Section 4. Terms of office. 22 The aforementioned 13 members shall continue to serve as 23 members of the council at the pleasure of the governmental body 24 or other designating entity and shall continue to serve as 25 members of the council until they cease to occupy the elected or 26 appointed office which entitles them to membership, at which 27 time the successor to the office shall become a member of the 28 council. A legislative member of the council shall continue to 29 serve as a member of the council during the interim between 30 sessions. 19770H1110B1287 - 2 -
1 Section 5. Compensation. 2 Members of the council (not to include the Federal members) 3 shall be entitled to actual vouchered expenses for each day such 4 member is in attendance at meetings or hearings or authorized 5 business of the council including time spent traveling to and 6 from the place of the meeting, hearing, or other authorized 7 business. 8 Section 6. Powers, rules and staffing. 9 The council shall have the power and duty to elect its own 10 chairman, vice chairman, and other officers, to make rules and 11 regulations governing its proceedings and to appoint such staff 12 as it deems necessary to properly perform its power and duties. 13 Such staff appointments to be made strictly within budgetary 14 constraints. 15 Section 7. Duties. 16 The council shall perform the following duties: 17 (1) Provide forum for bringing together the principal 18 elected and administrative officials of local and State 19 governments as well as regional Federal administrative 20 leaders involved in Pennsylvania affairs for communication, 21 consultation and coordination. 22 (2) Encourage, and where appropriate, coordinate studies 23 related to intergovernmental relations conducted by the 24 State, Federal, and local agencies, and other research- 25 oriented organizations. 26 Section 8. Reporting. 27 The council shall bi-annually issue a report of the progress 28 of its work accompanied by a financial statement to the 29 Governor, and the Speaker of the House, the President of the 30 Senate, the members of the council, and the chief executive 19770H1110B1287 - 3 -
1 officer of any organization providing funding for the council. 2 Section 9. Grants. 3 The council shall be empowered to receive grants or moneys 4 from any State, Federal or local government agency or other 5 source. 6 Section 10. Effective date. 7 This act shall take effect in 45 days and remain in effect 8 until June 30, 1979, unless the General Assembly shall extend 9 its effectiveness after thorough review of its performance.
