                                     AN ACT

     1  Requiring an economic impact statement to accompany proposed
     2     legislation or regulations dealing with environmental
     3     protection or pollution control.

     4     The General Assembly of the Commonwealth of Pennsylvania
     5  hereby enacts as follows:
     6  Section 1.  Economic impact statement required.
     7     Whenever a bill or a regulation dealing with environmental
     8  protection or pollution control is proposed by the General
     9  Assembly or by any State department or agency or any governing
    10  body or regulatory agency of a political subdivision, the
    11  proposed legislation or regulation shall be accompanied by an
    12  economic impact statement.
    13  Section 2.  Contents.
    14     The economic impact statement shall include where applicable:
    15         (1)  The technical feasibility and economic
    16     reasonableness of measuring or reducing the particular type


     1     of pollution.
     2         (2)  The estimated time and cost to rectify the alleged
     3     environmental infringement.
     4         (3)  The cost in lost wages or community benefits should
     5     an industry be forced to cease operations or a project be
     6     abandoned.
     7         (4)  The nature and severity of injury to, or
     8     interference with the protection of the health, general
     9     welfare, and physical property of the people should the
    10     alleged environmental violation go unresolved.
    11         (5)  The existing physical conditions, the character of
    12     the area involved, including the character of surrounding
    13     land uses, zoning classifications, and the nature of the
    14     existing air quality, or receiving body of water.
    15         (6)  A comparative analysis of the availability,
    16     efficiency, and cost of using an alternate energy source.
    17  Section 3.  Effective date.
    18     This act shall take effect immediately.
