        SENATOR COPPERSMITH, PUBLIC HEALTH AND WELFARE, IN SENATE,
           AS AMENDED, OCTOBER 19, 1977

                                     AN ACT

     1  Requiring advice of the need of a cytology (Papanicolaou) test
     2     for uterine cancer detection of certain women receiving
     3     hospital care, for the purpose of detecting uterine cancer
     4     early and reducing the morbidity and mortality therefrom.

     5     The General Assembly of the Commonwealth of Pennsylvania
     6  hereby enacts as follows:
     7     Section 1.  Any female 18 years of age or older who is
     8  accepted for any reason, either as an inpatient or outpatient,    <--
     9  in any hospital or clinic defined as such by the Commonwealth
    10  shall be advised of the purpose of and the availability of tests
    11  for the detection of uterine cancer, of an appropriate cytology
    12  test of the Papanicolaou type, to be examined and reported upon
    13  by an appropriate, qualified cytologist in a laboratory approved
    14  by the Department of Health UNLESS ONE OR MORE OF THE FOLLOWING   <--
    15  SITUATIONS EXIST:
    16         (1)  THE PROCEDURE IS CONTRAINDICATED BECAUSE OF THE
    17     MEDICAL CONDITION OF THE PATIENT.
    18         (2)  THE PROCEDURE IS REFUSED BY THE PATIENT.

     1         (3)  SCREENING UTERINE CYTOLOGY HAS BEEN OBTAINED IN THE
     2     PREVIOUS 12 MONTHS AND FOUND TO BE NORMAL.
     3         (4)  A CONTRADICTORY ORDER IS WRITTEN BY A RESPONSIBLE
     4     PHYSICIAN ON THE ORDER SHEET IN THE CHART.
     5     Section 2.  The Pennsylvania Department of Health is hereby    <--
     6  authorized to prepare directives to hospitals and clinics to
     7  include in the patient medical records a section indicating
     8  whether advisement of the intent and availability of tests is
     9  applicable, the date when such advice and information was
    10  offered and the name or initials of the person offering such
    11  advice and information. The attending physician shall be
    12  responsible for insuring that this form is completed.
    13     Section 3 2.  This act shall take effect in 60 days.           <--
