AN ACT
1 Amending the act of May 25, 1933 (P.L.1016, No.226), entitled,
2 "An act relating to aeronautics; providing for the
3 maintenance and operation of intermediate landing fields and
4 air navigation facilities by the Commonwealth alone or in
5 cooperation with the United States Government or political
6 subdivisions of the Commonwealth; providing for the execution
7 of leases or the issuance of licenses to the United States
8 Government or to political subdivisions of the Commonwealth
9 for the maintenance of navigation facilities on intermediate
10 landing fields of the Commonwealth; conferring powers and
11 duties on the Department of Revenue with respect thereto; and
12 repealing certain acts and parts of acts," further providing
13 for powers of the commission.
14 The General Assembly of the Commonwealth of Pennsylvania
15 hereby enacts as follows:
16 Section 1. The title and section 1, act of May 25, 1933
17 (P.L.1016, No.226), entitled, "An act relating to aeronautics;
18 providing for the maintenance and operation of intermediate
19 landing fields and air navigation facilities by the Commonwealth
20 alone or in cooperation with the United States Government or
21 political subdivisions of the Commonwealth; providing for the
22 execution of leases or the issuance of licenses to the United
23 States Government or to political subdivisions of the
1 Commonwealth for the maintenance of navigation facilities on
2 intermediate landing fields of the Commonwealth; conferring
3 powers and duties on the Department of Revenue with respect
4 thereto; and repealing certain acts and parts of acts," amended
5 May 21, 1943 (P.L.441, No.199), are amended, and section 1 is
6 amended by adding a clause to read:
7 AN ACT
8 Relating to aeronautics; providing for the maintenance and
9 operation of intermediate landing fields and air navigation
10 facilities by the Commonwealth alone or in cooperation with
11 the United States Government or political subdivisions of the
12 Commonwealth; providing for the execution of leases or the
13 issuance of licenses to the United States Government or to
14 political subdivisions of the Commonwealth for the
15 maintenance of navigation facilities on intermediate landing
16 fields of the Commonwealth; conferring powers and duties on
17 the [Department of Revenue] Pennsylvania Aeronautics
18 Commission with respect thereto; and repealing certain acts
19 and parts of acts.
20 Section 1. Be it enacted, &c., That the Pennsylvania
21 Aeronautics Commission, in connection with the designation and
22 establishment of civil airways within, over and above the lands
23 and waters of this Commonwealth as provided by law, shall have
24 the power, to the extent to which the General Assembly shall
25 have appropriated funds to it or the Department of [Property and
26 Supplies] General Services for the purpose:

28 (h) To promulgate rules and regulations governing the use of
29 all commercial landing facilities by civil aircraft where the
30 commission deems that those rules and regulations of the United

1 States Government are contrary to the interests of the health
2 and safety of the citizens of the Commonwealth of Pennsylvania.
3 Section 2. This act shall take effect immediately.
