AN ACT 1 Amending the act of May 2, 1929 (P.L.1513, No.451), entitled, as 2 amended, "An act regulating the construction, equipment, 3 maintenance, operation and inspection of boilers and unfired 4 pressure vessels; granting certain authority to and imposing 5 certain duties upon the Department of Labor and Industry; 6 providing penalties for violations of this act; and repealing 7 all acts or parts of acts inconsistent with this act," 8 providing for the acceptance of boilers and pressure vessels 9 constructed or installed for original use outside this 10 Commonwealth under certain conditions AND PROVIDING FOR <-- 11 CERTAIN APPROVALS AND FILINGS. 12 The General Assembly of the Commonwealth of Pennsylvania 13 hereby enacts as follows: 14 Section 1. The act of May 2, 1929 (P.L.1513, No.451), 15 referred to as the Boiler Regulation Law, is amended by adding a <-- 16 section SECTIONS to read: <-- 17 Section 4.2. Acceptance of Boilers and Pressure Vessels not 18 Originally Destined for Use within the Commonwealth.--Upon 19 special application to the department, boilers and pressure 20 vessels which were constructed and/or installed for original use 21 outside the Commonwealth or for use within Federal Government
1 installations, may be installed within the Commonwealth in 2 accordance with special requirements set forth as follows: 3 (1) Completion of a permission to move boilers and/or 4 unfired pressure vessels form. 5 (2) Furnishing of notarized mill test reports of material to 6 prove it meets present code requirements. 7 (3) Furnishing of calculations and stress analyses showing 8 the maximum allowable working pressure under the ASME Code. 9 These stress analyses shall be certified by a professional 10 engineer. 11 (4) If equipment is of welded construction, all seams that 12 are required to be X-rayed by the ASME Code shall be X-rayed. 13 (5) Establishment that welding was done by a certified ASME 14 welder and that the welding meets requirements of ASME Code. 15 (6) Subjection of equipment to hydrostatic test of one and 16 one-half times the maximum allowable working pressure. 17 (7) All tests shall be made under the supervision of a 18 Pennsylvania commissioned inspector. 19 (8) A data sheet comparable to the allowable ASME data 20 report form shall be submitted. 21 (9) The fact that mill test reports, names of welders, etc., 22 may have been lost to unforeseen circumstances, nevertheless it 23 is necessary to fulfill the basic requirements by some other 24 means. 25 (10) Payment of a fee of one hundred dollars to the 26 Department of Labor and Industry for services performed as to 27 testimony and processing. 28 SECTION 18.1. APPROVAL OF PLAN AND FEES THEREFORE.--THE <-- 29 OWNER, ARCHITECT, ENGINEER, OR CONTRACTOR SHALL SUBMIT TO THE 30 DIVISION OF BOILERS OF THE DEPARTMENT FOR APPROVAL, DRAWINGS, 19760H2118B3594 - 2 -
1 SPECIFICATIONS OR OTHER DATA SHOWING COMPLIANCE WITH THE 2 PROVISIONS OF THE ACT BEFORE ANY BOILER IS INSTALLED IN ANY 3 ESTABLISHMENT OR PLACE OF PUBLIC ASSEMBLY IN THIS COMMONWEALTH. 4 THE FEES FOR THE PLANS TO BE SUBMITTED ARE AS FOLLOWS: 5 (1) COMPLETE MECHANICAL ROOM DRAWINGS - 6 BOILERS AND OTHER VESSELS................ $25.00; 7 (2) HIGH PRESSURE BOILERS.................... 5.00; 8 (3) LOW PRESSURE BOILERS..................... 10.00; 9 (4) LIQUEFIED PETROLEUM PLOT PLANS........... 10.00. 10 Section 2.
