           NOVEMBER 9, 1976

                                     AN ACT

     1  Amending the act of July 20, 1974 (P.L.551, No.190), entitled
     2     "An act relating to the right to practice medicine and
     3     surgery in the Commonwealth of Pennsylvania; and establishing
     4     means and methods whereby the right to practice medicine and
     5     surgery and any of its branches and limited right to practice
     6     medically related acts may be obtained, and exemptions
     7     therefrom; imposing powers and duties on the State Board of
     8     Medical Education and Licensure; providing for appropriation
     9     of board fees to carry out the provisions thereof, and for
    10     the granting, revocation and suspension of licenses;
    11     providing penalties for violations; and making repeals,"
    12     providing for licensure of graduates of foreign medical
    13     schools upon completion of certain requirements and providing
    14     for the establishment of programs of clinical training in
    15     hospitals and making an appropriation.

    16     The General Assembly of the Commonwealth of Pennsylvania
    17  hereby enacts as follows:
    18     Section 1.  The act of July 20, 1974 (P.L.551, No.190), known
    19  as the "Medical Practice Act of 1974," is amended by adding a
    20  section to read:
    21     Section 6.1.  Graduates of Foreign Medical Schools.--(a) A


     1  document granted by a medical school located outside the United
     2  States, which is recognized LISTED by the World Health            <--
     3  Organization, issued after the completion of all the formal
     4  requirements of the foreign medical school except internship and
     5  social service, upon certification by the medical school in
     6  which the training was received of satisfactory completion by
     7  the person to whom the document was issued of the requirements
     8  listed in this section, shall be considered the equivalent of a   <--
     9  Degree of Doctor of Medicine for purposes of licensing and
    10  practice as a physician in the Commonwealth. QUALIFY A PERSON     <--
    11  FOR PARTICIPATION IN "FIFTH PATHWAY" PROGRAMS AS HEREINAFTER
    12  DEFINED. PARTICIPATING MEDICAL SCHOOLS MAY REQUIRE SUCH
    13  ADDITIONAL EVIDENCE OF STUDENT FITNESS FOR ADMISSION INTO "FIFTH
    14  PATHWAY" PROGRAMS AS THEY DEEM NECESSARY.
    15     (b)  The Commonwealth of Pennsylvania through the Department
    16  of Education shall fund adequate programs of clinical training
    17  for students in "fifth pathway" programs established by medical
    18  schools in Pennsylvania as prescribed by the Council on Medical
    19  Education of the American Medical Association in hospitals        <--
    20  TEACHING HOSPITALS AFFILIATED WITH MEDICAL SCHOOLS to meet the    <--
    21  needs of all those United States of America citizens who were
    22  legal residents of Pennsylvania immediately prior to entering a
    23  foreign medical school, provided that the requirements of said
    24  programs shall not be more stringent than BE EQUIVALENT TO those  <--
    25  recommended by the Council on Medical Education of the American
    26  Medical Association.
    27     (c)  The Department of Education may, before funding any
    28  program of clinical training established pursuant to subsection
    29  (b), require each medical school to submit such information as
    30  the department deems necessary to determine that each medical

     1  school complies with all the guidelines established for clinical
     2  training programs by the Council on Medical Education of the
     3  American Medical Association. SUCCESSFUL COMPLETION BY THE        <--
     4  STUDENT OF THE REQUIREMENTS OF THE "FIFTH PATHWAY" PROGRAM SHALL
     5  BE DEEMED THE EQUIVALENT OF A DEGREE OF DOCTOR OF MEDICINE FOR
     6  PURPOSES OF LICENSING AND PRACTICE AS A PHYSICIAN IN THE
     7  COMMONWEALTH.
     8     Section 2.  The sum of $200,000 or as much thereof as may be
     9  necessary is specifically appropriated to the Department of
    10  Education for the fiscal year July 1, 1976 1977 to June 30, 1977  <--
    11  1978 for payment to qualified medical schools at a capitation     <--
    12  rate of $7,500 per student who is a citizen of the United States
    13  of America and a legal resident of Pennsylvania immediately
    14  prior to entering a foreign medical school, for each year the     <--
    15  student is enrolled FOR A ONE YEAR "FIFTH PATHWAY" PROGRAM. IN    <--
    16  THE EVENT A MEDICAL SCHOOL REQUIRES A PROGRAM OF MORE THAN ONE
    17  YEAR'S DURATION FOR ONE OR MORE OF ITS "FIFTH PATHWAY" STUDENTS,
    18  IT SHALL BE THE RESPONSIBILITY OF THE STUDENT AND/OR MEDICAL
    19  SCHOOL TO ASSUME ALL FURTHER COSTS.
    20     Section 3.  This act shall take effect July 1, 1976. 1977.     <--
