           REPRESENTATIVES, AS AMENDED, JANUARY 27, 1976

                                     AN ACT

     1  Amending the act of June 3, 1937 (P.L.1333, No.320), entitled
     2     "An act concerning elections, including general, municipal,
     3     special and primary elections, the nomination of candidates,
     4     primary and election expenses and election contests; creating
     5     and defining membership of county boards of elections;
     6     imposing duties upon the Secretary of the Commonwealth,
     7     courts, county boards of elections, county commissioners;
     8     imposing penalties for violation of the act, and codifying,
     9     revising and consolidating the laws relating thereto; and
    10     repealing certain acts and parts of acts relating to
    11     elections," further defining certain terms used in this act.

    12     The General Assembly of the Commonwealth of Pennsylvania
    13  hereby enacts as follows:
    14     Section 1.  Section 1605.1, act of June 3, 1937 (P.L.1333,
    15  No.320), known as the "Pennsylvania Election Code," amended May
    16  12, 1975 (No.1), is amended to read:
    17     Section 1605.1.  Report of Contributions; Duty of Secretary
    18  of Commonwealth.--
    19     (a)  Any business entity, including but not limited to a
    20  corporation, company, association, partnership or sole
    21  proprietorship, AND EXCLUDING A NONPROFIT ORGANIZATION OF ANY     <--
    22  KIND which has been awarded non-bid contracts from the


     1  Commonwealth [and] OR ANY OF its political subdivisions during    <--
     2  the preceding calendar year, shall report by October 15, 1975
     3  and by [February] June fifteenth in each subsequent year to the
     4  Secretary of the Commonwealth an itemized list of all political
     5  contributions known to the business entity by virtue of the
     6  knowledge possessed by every officer, director, associate,
     7  partner, limited partner or individual owner that [has] HAVE      <--
     8  been made DURING THE PRECEDING YEAR by (1) any officer,           <--
     9  director, associate, partner, limited partner, individual owner
    10  or members of their immediate family and (2) any employe or
    11  members of his immediate family whose political contribution
    12  exceeded one thousand dollars ($1,000).  during the preceding     <--
    13  year. For the purposes of this subsection, "immediate family"
    14  means a person's spouse and any unemancipated child; "director"
    15  does not include any director who is not otherwise an officer or
    16  employe of the entity, and does not have legal or beneficial
    17  ownership of any shares or other interest in the entity;
    18  "officer" does not include any person who is not chairman or
    19  vice-chairman of the board or executive committee; president,
    20  vice-president or person performing similar executive functions,
    21  and does not have legal or beneficial ownership of any shares or
    22  other interest in the entity. In the case of a business entity
    23  which has more than twenty-five employes, "employe" means any
    24  person who has legal or beneficial ownership of any shares or
    25  other interests in the entity. "Non-bid contracts" MEANS          <--
    26  CONTRACTS FOR ARCHITECTURAL, ENGINEERING OR LEGAL SERVICES,
    27  CONTRACTS for construction or maintenance of roads and highways,
    28  contracts for construction, alteration, repair, maintenance or
    29  additions to buildings, plant fixtures, and contracts for
    30  purchase of materials, equipment, furnishings, fuel and other

     1  supplies, except those for which the prices or charges are
     2  established by means of a published or readily available price
     3  list, any of which are let without bidding and for which the
     4  prices or charges are not subject to approval by or filing with
     5  any regulatory agency, having jurisdiction over rates or charges
     6  of the contractor.
     7     (b)  It shall be the duty of the Secretary of the
     8  Commonwealth to publish sixty days after October 15, 1975 and
     9  sixty days after [February] June fifteenth of each subsequent
    10  year a complete itemized list of all contributions given under
    11  the provisions of subsection (a). This list shall be a matter of
    12  public record open to public inspection and copies made
    13  available at cost to any individual who requests the same.
    14     (c)  A filing on or before October 15, 1975 of the
    15  information required in this section shall constitute compliance
    16  with the filing requirements of this act for the calendar year
    17  1974.
    18     Section 2.  This act shall take effect immediately.
