AN ACT
1 Amending the act of July 15, 1935 (P.L.998, No.317), entitled
2 "An act authorizing the Department of Highways to enter into
3 an agreement or agreements with the Department of Public
4 Works of the State of New York for the construction,
5 reconstruction, or maintenance, under certain terms and
6 conditions, of free bridges across the Delaware River;
7 granting certain powers to the Department of Highways in
8 connection with the construction, reconstruction, or
9 maintenance of such bridges and approaches thereto; and
10 making an appropriation," further providing for costs and
11 expenses.
12 The General Assembly of the Commonwealth of Pennsylvania
13 hereby enacts as follows:
14 Section 1. Section 2, act of July 15, 1935 (P.L.998,
15 No.317), entitled "An act authorizing the Department of Highways
16 to enter into an agreement or agreements with the Department of
17 Public Works of the State of New York for the construction,
18 reconstruction, or maintenance, under certain terms and
19 conditions, of free bridges across the Delaware River; granting
20 certain powers to the Department of Highways in connection with
21 the construction, reconstruction, or maintenance of such bridges
22 and approaches thereto; and making an appropriation," is amended
1 to read:
2 Section 2. Said agreement or agreements shall provide that
3 the cost and expense of constructing, reconstructing, or
4 maintaining said bridges shall be borne as follows: as to the
5 bridges proper, fifty (50) per centum by the Commonwealth of
6 Pennsylvania and fifty (50) per centum by the State of New York;
7 as to construction, reconstruction or maintenance of bridge
8 approaches in Pennsylvania, the costs thereof shall be paid
9 entirely by the Commonwealth of Pennsylvania; if the bridge
10 approach is in New York, the Commonwealth shall have no
11 liability for payment of construction, reconstruction or
12 maintenance costs thereof.
13 Section 2. This act shall take effect immediately.
