the House of Representatives and Senate for the purpose of
considering House Bill No. 1333, entitled:
"AN ACT Making an appropriation AMENDING THE ACT OF JUNE 30,
1975 (NO.8-A), ENTITLED 'AN ACT TO PROVIDE FOR THE EXPENSES OF
THE EXECUTIVE, LEGISLATIVE AND JUDICIAL DEPARTMENTS OF THE

AN ACT 1 Amending the act of June 30, 1975 (No.8-A), entitled "An act to 2 provide for the expenses of the Executive, Legislative and 3 Judicial Departments of the Commonwealth, the public debt and 4 for the public schools for the fiscal period July 1, 1975 to 5 June 30, 1976, and for the payment of bills incurred and 6 remaining unpaid at the close of the fiscal period ending 7 June 30, 1975," providing that the appropriation to the 8 Department of Community Affairs for housing and redevelopment 9 assistance and the appropriation to the Legislative 10 Department shall not lapse; changing or amending certain 11 appropriations to the Governor, the Pennsylvania Council on 12 the Arts, the Governor's Council on Drug and Alcohol Abuse, 13 the Auditor General, the Treasury Department, the Department 14 of Agriculture, the Department of Banking, the Department of 15 Commerce, the Department of Community Affairs, the Department 16 of Education, the Department of Environmental Resources, the 17 Department of Health, the Pennsylvania Historical and Museum 18 Commission, the Department of Insurance, the Department of 19 Justice, the Department of Labor and Industry, the Department 20 of Military Affairs, the Pennsylvania Board of Probation and 21 Parole, the Department of Property and Supplies, the 22 Department of Public Welfare, the Department of Revenue, the 23 Department of State, the Pennsylvania State Police, the State 24 Tax Equalization Board, the Department of Transportation, to 25 the Chief Clerk of the Senate, to the Senate and House of 26 Representatives for expenses of the Members, to the Majority 27 and Minority Leadership Accounts of the Senate and House of 28 Representatives, and to the Majority and Minority Legislative 29 Management Accounts of the House of Representatives; 30 clarifying appropriations to the General Assembly; adding 31 appropriations to the Governor for the National Governor's 32 Conference, to the Department of Community Affairs for 33 housing and redevelopment assistance, to the Department of 34 Commerce for the community facilities program, to the 35 Department of Environmental Resources for Presque Isle State 36 Park, to the Department of Public Welfare for payments to 37 second class counties for county homes, to the House of 38 Representatives for expenses of the members; reinstating and 39 reenacting appropriations to the Department of Public Welfare 40 for child welfare programs and the food stamp program, and to 41 the Judicial Department for county reimbursement for court 42 costs; and transferring, reinstating and reenacting an 43 appropriation to the Department of Health from the Department 44 of Public Welfare for grants to county departments of health. 45 The General Assembly of the Commonwealth of Pennsylvania 46 hereby enacts as follows: 47 Section 1. Section 2, act of June 30, 1975 (No.8-A), known 48 as the "General Appropriation Act of 1975," is amended by 49 changing or amending certain appropriations to the Governor, the 50 Pennsylvania Council on the Arts, the Governor's Council on Drug
1 and Alcohol Abuse, the Auditor General, the Treasury Department, 2 the Department of Agriculture, the Department of Banking, the 3 Department of Commerce, the Department of Community Affairs, the 4 Department of Education, the Department of Environmental 5 Resources, the Department of Health, the Pennsylvania Historical 6 and Museum Commission, the Department of Insurance, the 7 Department of Justice, the Department of Labor and Industry, the 8 Department of Military Affairs, the Pennsylvania Board of 9 Probation and Parole, the Department of Property and Supplies, 10 the Department of Public Welfare, the Department of Revenue, the 11 Department of State, the Pennsylvania State Police, the State 12 Tax Equalization Board, the Department of Transportation, the 13 Chief Clerk of the Senate, to the Senate for the expenses of the 14 members, and to the House of Representatives for the expenses of 15 the members, the Appropriations Committees of the Senate and 16 House of Representatives, the Majority and Minority Leadership 17 Accounts of the Senate and House of Representatives, and the 18 Majority and Minority Legislative Management Accounts of the 19 House of Representatives; by adding appropriations to the 20 Governor for the National Governor's Conference, to the 21 Department of Community Affairs for housing and redevelopment 22 assistance, to the Department of Commerce for the community 23 facilities program, to the Department of Environmental 24 Resources, to the Department of Public Welfare for payments to 25 second class counties for county homes, to the House of 26 Representatives; by reinstating and reenacting appropriations to 27 the Department of Public Welfare for child welfare programs and 28 the food stamp program, and to the Judicial Department for 29 county reimbursement for court costs; and by transferring, 30 reinstating and reenacting an appropriation to the Department of 19750H1333B2102 - 2 -

The following sums, or as much thereof as may be 4 necessary, are hereby specifically appropriated from the General 5 Fund to the several hereinafter named agencies of the Executive, 6 Legislative and Judicial Departments of the Commonwealth for the 7 payment of the salaries, wages or other compensation and travel 8 expense of the duly elected or appointed officers and employees 9 of the Commonwealth, for payment of fees of contractual services 10 rendered, for the purchase or rental of goods, services, 11 printing, equipment, land and buildings and for payment of any 12 other expenses, as provided by law or by this act, necessary for 13 the proper conduct of the duties, functions and activities and 14 for the purposes hereinafter set forth for the fiscal period 15 beginning July 1, 1975 and for the payment of bills incurred and 16 remaining unpaid at the close of the fiscal period ending June 17 30, 1975. 18 I. The 24 committee shall have the authority to examine and 25 inspect all properties, equipment, facilities, 26 files, records and accounts of any State office, 27 department, institution, board, committee, commis- 28 sion or agency or any institution or agency 29 supported, in whole or in part, by appropriation 30 from the State Treasury and to administer oaths. 19750H1333B2102 - 17 -
1 The committee may issue subpoenas under the hand
2 and seal of the chairman to compel the attendance
3 of witnesses and the production of any papers,
4 books, accounts, documents and testimony touching
5 matters properly being inquired into by the commit-
6 tee and to cause the deposition of witnesses either
7 residing within or without the State to be taken
8 in the manner prescribed by laws for taking deposi-
9 tions in civil actions. The sum appropriated shall be
10 paid on warrant of the State Treasurer in favor of
11 the chairman of said committee on the presentation
12 of his requisition for the same. The Chairman of
13 the Committee on Appropriations shall not later
14 than 30 days after the termination of his term
15 of office, or until his successor is elected and
16 also within 30 days after the adjournment of
17 any regular or special session, file an account,
18 together with supporting documents, whenever possible,
19 in the office of the Appropriation Committee of the
20 committee's expenses since the filing of the prior

2 and Commonwealth Courts in the county of their resi-
3 dence. Costs incurred by the counties in the administration
4 and operation of all courts means costs as reported to the
5 Department of Community Affairs in the county's
6 annual financial report forms under the heading
7 (a) "Judicial," but confined to the subheading: (160) courts,
8 excluding capital outlay. If a city coter-
9 minous with a county does not report on the De-
10 partment of Community Affairs' form, its figures
11 from the same subheading, set forth in the depart-
12 ment forms, shall be used: Provided, That such
13 payments shall be made to the County Treasurer
14 and in cities of the first class coterminous with
15 counties of the first class to the City Treasurer:
16 And, provided further, That in the event the amount
17 herein appropriated is not sufficient to reimburse
18 all such costs, payments shall be made to the
19 counties in the proportion which the costs of
20 each county bears to the total costs of all counties
21 during the most recently completed fiscal year:
22 And provided further, That in making allocations
23 and payments hereunder, the Court Administrator of
24 Pennsylvania shall, except for county offices
25 of justices and judges of the Supreme, Superior
26 and Commonwealth Courts, exclude all costs which are not
27 properly reportable under the heading herein-

29 Section 2. Section 9 of the act is amended to read:
30 Section 9. [That] (a) Except as provided in subsection (b),

1 that part of all appropriations in this act unexpended, 2 uncommitted and unencumbered as of June 30, 1976 shall 3 automatically lapse as of that date. 4 (b) The appropriation to the Department of Community Affairs 5 for housing and redevelopment assistance and the appropriations 6 to the Legislative Department shall not lapse. 7 Section 3.
