AN ACT
1 Making an appropriation to the Department of Justice for the
2 payment of certain moral claims against the Commonwealth.
3 The General Assembly of the Commonwealth of Pennsylvania
4 hereby enacts as follows:
5 Section 1. The sum of $24,000, or as much thereof as may be <--
6 necessary, is hereby specifically appropriated to the Department
7 of Justice of the Commonwealth of Pennsylvania for the payment
8 of moral claims against the Commonwealth arising from the
9 imprisonment for approximately 26 years for the alleged
10 commission of a crime.
11 Section 2. The sum of $16,000, or as much thereof as may be <--
12 necessary, is hereby specifically appropriated to the Department
13 of Justice of the Commonwealth of Pennsylvania for the payment
14 of moral claims against the Commonwealth arising out of a
15 personal injury, including but not limited to, the loss of four
16 fingers, while incarcerated in a State penal institution.
17 SECTION 1. THE SUM OF $50,000, OR AS MUCH THEREOF AS MAY BE <--
1 NECESSARY, IS HEREBY SPECIFICALLY APPROPRIATED TO THE DEPARTMENT
2 OF JUSTICE OF THE COMMONWEALTH OF PENNSYLVANIA FOR THE PAYMENT
3 OF MORAL CLAIMS AGAINST THE COMMONWEALTH ARISING FROM THE
4 WRONGFUL IMPRISONMENT FOR APPROXIMATELY 26 YEARS AS A RESULT OF
5 A CONVICTION, BASED ONLY ON ERRONEOUS AND IMPROPER EVIDENCE AT A
6 TRIAL FOR THE ALLEGED COMMISSION OF A CRIME AND FOR
7 REIMBURSEMENT OF ANY LOSS DUE TO PERSONAL INJURY, INCLUDING, BUT
8 NOT LIMITED TO, THE LOSS OF FOUR FINGERS, REPUTATION, GOODWILL,
9 SAVINGS, ATTORNEY'S FEES AND OTHER FEES IN DEFENSE AGAINST
10 PROSECUTION FOR THE AFORESAID CRIME AS WELL AS ANY OTHER
11 PHYSICAL OR MENTAL DEPRIVATION, INCLUDING THE DEPRIVATION OR
12 PERSONAL OR CIVIL RIGHTS.
13 Section 3. 2. Payment from said appropriation shall be made <--
14 by requisition of the Department of Justice of the Commonwealth
15 of Pennsylvania upon proof of claims to the satisfaction of the
16 Department of Justice and the State Treasurer.
17 Section 4. 3. This act shall take effect immediately. <--
