AN ACT
1 Making an appropriation to the Department of Justice for the
2 payment of certain moral claims against the Commonwealth.
3 The General Assembly of the Commonwealth of Pennsylvania
4 hereby enacts as follows:
5 Section 1. The sum of $40,000 $24,000, or as much thereof as <--
6 may be necessary, is hereby specifically appropriated to the
7 Department of Justice of the Commonwealth of Pennsylvania for
8 the payment of moral claims against the Commonwealth arising
9 from the wrongful imprisonment for approximately 26 years as a <--
10 result of a conviction, based only on erroneous and improper
11 evidence at a trial for the alleged commission of a crime. and <--
12 for reimbursement of any loss due to personal injury, including,
13 but not limited to, the loss of four fingers, reputation,
14 goodwill, savings, attorney's fees and other fees in defense
15 against prosecution for the aforesaid crime as well as any other
16 physical or mental deprivation, including the deprivation or
17 personal or civil rights.
18 SECTION 2. THE SUM OF $16,000, OR AS MUCH THEREOF AS MAY BE <--
1 NECESSARY, IS HEREBY SPECIFICALLY APPROPRIATED TO THE DEPARTMENT
2 OF JUSTICE OF THE COMMONWEALTH OF PENNSYLVANIA FOR THE PAYMENT
3 OF MORAL CLAIMS AGAINST THE COMMONWEALTH ARISING OUT OF A
4 PERSONAL INJURY, INCLUDING BUT NOT LIMITED TO, THE LOSS OF FOUR
5 FINGERS, WHILE INCARCERATED IN A STATE PENAL INSTITUTION.
6 Section 2. 3. Payment from said appropriation shall be made <--
7 by requisition of the Department of Justice of the Commonwealth
8 of Pennsylvania upon proof of claims to the satisfaction of the
9 Department of Justice and the State Treasurer.
10 Section 3. 4. This act shall take effect immediately. <--
