AN ACT 1 Amending the act of May 2, 1899 (P.L.163, No.111), entitled "An 2 act legalizing, and making it lawful to build, fences 3 constructed in whole or in part of wire along the public 4 highways, and as division fences," providing for fences with 5 barbs. 6 The General Assembly of the Commonwealth of Pennsylvania 7 hereby enacts as follows: 8 Section 1. The act of May 2, 1899 (P.L.163, No.111), 9 entitled "An act legalizing, and making it lawful to build, 10 fences constructed in whole or in part of wire along the public 11 highways, and as division fences," is amended to read: 12 Section 1. Be it enacted, &c., That it shall and is hereby 13 declared to be lawful for any land owner within this 14 Commonwealth to construct, build and maintain, along any of the 15 highways of this Commonwealth, fences made in whole or in part 16 of wire, with or without barbs, subject at all times to such 17 restrictions and prohibitions as may be imposed by the municipal 18 authorities relative thereto. 19 Section 2. A fence, in whole or in part of wire, with or
1 without barbs, is hereby declared to be a legal and lawful 2 fence, within the meaning and provisions of any act of the 3 Legislature of this State relative to the building, constructing 4 and maintaining of line fences, provided that such wire fence 5 shall be of the height required by such act or acts. All 6 statutes and parts of statutes inconsistent herewith be and the 7 same are hereby repealed. 8 Section 2. This act shall take effect immediately. C14L33JKD/19750H0807B0910 - 2 -
