                                     AN ACT

     1  Prohibiting junk yards or scrap yards within a certain distance
     2     of State highways, requiring certain others to have fences so
     3     that material therein is not visible from the highway and
     4     prescribing penalties.

     5     The General Assembly of the Commonwealth of Pennsylvania
     6  hereby enacts as follows:
     7     Section 1.  No person shall engage in the operation or
     8  maintenance of a junk yard or scrap yard including, but not
     9  limited to, automobile junk or grave yards, any part of which is
    10  located within one thousand feet of the right-of-way of any
    11  State highway. The owner or operator of any junk yard or scrap
    12  yard which is visible from a State highway shall erect, and
    13  thereafter maintain in good repair, an opaque fence of
    14  substantial construction and of sufficient height so that
    15  material in such junk yard or scrap yard is not visible from the
    16  State highway.
    17     Section 2.  Any person who violates the provisions of this
    18  act shall, upon conviction thereof in a summary proceeding, be
    19  sentenced to pay a fine of $100 and costs of prosecution and in

     1  default of payment of such fine and costs, such person or the
     2  responsible officers or employes of a corporation shall undergo
     3  imprisonment for 30 days. Every day in which a violation occurs
     4  shall be considered a separate offense.
