To the Members of the Senate and House of Representatives:
We, the undersigned, Committee of Conference on the part of the Senate and House of Representatives for the purpose of considering House Bill No. 999, entitled: "A supplement to the act of April 1, 1863 (P.L.213, No.227), entitled 'An act to accept the grant of Public Lands, by the United States, to the several states, for the endowment of Agricultural Colleges,' making appropriations for carrying the same into effect, providing for a basis for payments of such appropriations and providing a method of accounting for the funds appropriated," respectfully submit the following bill as our report: HENRY J. A SUPPLEMENT 1 To the act of April 1, 1863 (P.L.213, No.227), entitled "An act 2 to accept the grant of Public Lands, by the United States, to 3 the several states, for the endowment of Agricultural 4 Colleges," making appropriations for carrying the same into 5 effect, providing for a basis for payments of such 6 appropriations and providing a method of accounting for the 7 funds appropriated. 8 The General Assembly of the Commonwealth of Pennsylvania 9 hereby enacts as follows: 10 Section 1. In order to carry into effect the act of 11 Congress, approved July 2, 1862, granting public land to the 12 several states for educational purposes, and subsequent acts of 13 Congress related thereto, and the act of the General Assembly of 14 Pennsylvania accepting the provisions and conditions of said 15 acts of Congress and pledging the faith of the State to carry 16 the same into effect, the following sums or as much thereof as 17 may be necessary are hereby specifically appropriated to the 18 Trustees of the Pennsylvania State University for the fiscal 19 year July 1, 1973 to June 30, 1974, for the purposes and in the 20 amounts as shown: 21 (1) For net cost of instruction excluding 22 Doctor of Medicine........................ $58,372,000 23 (2) For net cost of student aid............... 1,760,000 24 (3) For net cost of extension and public 25 services.................................. 8,913,000 26 (4) For net cost of research.................. 15,800,000 27 (5) For instruction - Doctor of Medicine 28 only...................................... 2,314,000 29 Section 2. Payments to Pennsylvania State University on 30 account of the appropriations for all items as provided in 31 section 1 of this act except for instruction - Doctor of
1 Medicine shall be made on the basis of net costs during the 2 fiscal year. 3 Payments for instruction - Doctor of Medicine shall be made 4 on the basis of full-time equivalent students enrollment at the 5 rate of seven thousand four hundred sixty-five dollars ($7,465) 6 per student. 7 Section 3. If necessary, the Pennsylvania State University 8 may transfer funds among the appropriations listed in section 1, 9 clauses (1), (2), (3) and (4): Provided, That the aggregate 10 amount transferred into or out of each appropriation during the 11 fiscal year shall not exceed five per cent of the amount 12 specifically appropriated for that purpose. 13 Section 4. Payments to the Pennsylvania State University of 14 the appropriations herein provided shall be made monthly during 15 the fiscal year. 16 Such monthly payments shall be made in accordance with the 17 provisions of sections 2 and 3 of this act, on the basis of 18 estimated net costs and full-time equivalent students enrolled 19 in the Doctor of Medicine program. The estimate of net costs 20 shall be submitted by the Pennsylvania State University to the 21 Secretary of Education, the General Assembly and to the State 22 Treasurer not later than thirty days prior to the date on which 23 such payment is to be made. 24 Section 5. The Pennsylvania State University shall apply the 25 moneys appropriated by this act only for such purposes as are 26 permitted in this act and shall at all times maintain proper 27 records showing the application of such moneys. Not later than 28 one hundred twenty days after the close of the fiscal year to 29 which this act relates, the Pennsylvania State University shall 30 file with the Secretary of Education, the General Assembly, and 19730H0999B2012 - 2 -
1 with the Auditor General of the Commonwealth, a statement 2 setting forth the amounts and purposes of all expenditures made 3 from moneys appropriated by this act and other university 4 accounts during said fiscal year, the number of full-time 5 equivalent students enrolled in the Doctor of Medicine program 6 and net costs, as provided in sections 2 and 3 of this act, used 7 as a basis for receipt of any appropriation during said fiscal 8 year. 9 Such statement of expenditures and number of full-time 10 equivalent students enrolled in the Doctor of Medicine program 11 and net costs shall be reviewed by the Auditor General of the 12 Commonwealth, and he shall have the right, in respect to the 13 moneys appropriated by this act, to audit and disallow 14 expenditures made for purposes not permitted by this act and to 15 cause such sums to be recovered and paid by the Pennsylvania 16 State University to the Treasurer of the Commonwealth. The 17 Auditor General shall also make a determination of full-time 18 equivalent students enrolled in the Doctor of Medicine program 19 and net costs and make a certification as to their correctness. 20 In respect to expenditures made by the university from moneys 21 other than those appropriated by this act, the Auditor General 22 shall have the right to review only and he shall file annually 23 with the General Assembly such information concerning such 24 expenditures as the General Assembly or any of its committees 25 may require. 26 Section 6. Two reports shall be submitted to the Governor 27 and the Appropriations and Education Committees of the Senate 28 and House of Representatives and shall include data for all 29 programs of the university except the Doctor of Medicine 30 program. The first report, to be submitted prior to December 1, 19730H0999B2012 - 3 -
1 1973, shall cover the period from June 25, 1973 to August 18, 2 1973. The second report, to be submitted prior to November 1, 3 1974, shall cover the twelve-month period beginning September 1, 4 1973. Each report shall include for each term during the period: 5 (1) The following counts and distributions: 6 (i) The definitions and numbers of full-time faculty 7 members, of part-time faculty members, of full-time students 8 enrolled in graduate courses, of full-time students enrolled in 9 undergraduate courses, of part-time students enrolled in 10 graduate courses, and of part-time students enrolled in 11 undergraduate courses; 12 (ii) A distribution of part-time faculty members by the 13 percentage of full-time employment; 14 (iii) Total numbers of undergraduate student credits and of 15 graduate student credits; 16 (iv) Number of different courses scheduled, distributed by 17 the number of sections scheduled in each course and the sections 18 distributed by the number of students enrolled in each section; 19 (v) Number of terms scheduled and the dates thereof. 20 (2) A classification of faculty members or other 21 professional employees by title including: professor, associate 22 professor, assistant professor, instructor, lecturer, research 23 associate, librarian, and academic administrator; faculty 24 members or other professional employees under each title to be 25 subdivided by type of assignment: undergraduate courses only, 26 graduate courses only, or both graduate and undergraduate 27 courses; and each such set of faculty members or other 28 professional employees to be further subdivided by type of 29 employment: full-time or part-time; and the following aggregates 30 for each such subdivided classification: 19730H0999B2012 - 4 -
1 (i) The number; 2 (ii) The sum of credits assigned to undergraduate courses 3 taught; 4 (iii) The sum of credits assigned to graduate courses 5 taught; 6 (iv) The sum of undergraduate student credits and the sum of 7 graduate student credits generated; 8 (v) Total salary paid; 9 (vi) Total salary paid from Federal funds; 10 (vii) Total salary paid from university funds. 11 (3) For each term of the period covered an analysis of the 12 average hours per week spent in university-related activities 13 for each full-time faculty member identified by school, 14 department and title. 15 Section 7. In addition to the requirements of section 6, the 16 report covering the twelve-month period beginning September 1, 17 1973 shall include for all programs of the university except the 18 Doctor of Medicine program: 19 (1) Minimum number of credits required for a baccalaureate 20 degree, and for a master's degree. 21 (2) Number of bachelor's degrees, master's degrees, first 22 professional degrees, and doctoral degrees awarded in 1971, 23 1972, 1973, and estimated 1974. 24 Section 8. The Pennsylvania State University shall report 25 its revenues and expenditures and present its financial 26 statements required under the provisions of this act in 27 accordance with generally accepted accounting principles and 28 procedures for educational institutions as set forth in "College 29 and University Business Administration" of the American Council 30 on Education, Revised Edition, 1968, without exception. 19730H0999B2012 - 5 -
