A SUPPLEMENT 1 To the act of April 1, 1863 (P.L.213, No.227), entitled "An act 2 to accept the grant of Public Lands, by the United States, to 3 the several states, for the endowment of Agricultural 4 Colleges," making appropriations for carrying the same into 5 effect, providing for a basis for payments of such 6 appropriations and providing a method of accounting for the 7 funds appropriated. 8 The General Assembly of the Commonwealth of Pennsylvania 9 hereby enacts as follows: 10 Section 1. In order to carry into effect the act of 11 Congress, approved July 2, 1862, granting public land to the 12 several states for educational purposes, and subsequent acts of 13 Congress related thereto, and the act of the General Assembly of 14 Pennsylvania accepting the provisions and conditions of said 15 acts of Congress and pledging the faith of the State to carry 16 the same into effect, the following sums or as much thereof as 17 may be necessary are hereby specifically appropriated to the 18 Trustees of the Pennsylvania State University for the fiscal 19 year July 1, 1973 to June 30, 1974, for the purposes and in the 20 amounts as shown:
1 (1) For net cost of instruction AND STUDENT <-- 2 AID excluding Doctor of Medicine.......... $58,226,000 <-- 3 $60,552,000 4 (2) For net cost of student aid.................. 1,756,000 <-- 5 (3) (2) For net cost of extension and public <-- 6 services..................................... 8,891,000 <-- 7 8,976,000 8 (4) (3) For net cost of sponsored <-- 9 research................................. 2,169,000 <-- 10 15,912,000 11 (5) For net cost of other research............... 13,592,000 <-- 12 (6) (4) For instruction - Doctor of Medicine <-- 13 only......................................... 2,314,000 14 Section 2. Payments to Pennsylvania State University on 15 account of the appropriations for all items as provided in 16 section 1 of this act except for instruction - Doctor of 17 Medicine shall be made on the basis of net costs during the 18 fiscal year. 19 Payments for instruction - Doctor of Medicine shall be made 20 on the basis of full-time equivalent students enrollment at the 21 rate of seven thousand four hundred sixty-five dollars ($7,465) 22 per student. 23 Section 3. If necessary, the Pennsylvania State University 24 may transfer funds among the appropriations listed in section 1, 25 clauses (1), (2) AND (3), (4) and (5): Provided, That the <-- 26 aggregate amount transferred into or out of each appropriation 27 during the fiscal year shall not exceed ten per cent of the 28 amount specifically appropriated for that purpose. 29 Section 4. Payments to the Pennsylvania State University of 30 the appropriations herein provided shall be made quarterly <-- 19730H0999B1754 - 2 -
1 MONTHLY during the fiscal year. as follows: <-- 2 (1) First payment on September 30, 1973. 3 (2) Second payment on December 31, 1973. 4 (3) Third payment on March 31, 1974. 5 (4) Fourth payment on June 30, 1974. 6 Such quarterly MONTHLY payments shall be made in accordance <-- 7 with the provisions of sections 2 and 3 of this act, on the 8 basis of estimated net costs and full-time equivalent students 9 enrolled in the Doctor of Medicine program. The estimate of net 10 costs shall be submitted by the Pennsylvania State University to 11 the Secretary of Education, the General Assembly and to the 12 State Treasurer not later than thirty days prior to the date on 13 which such payment is to be made. 14 Section 5. The Pennsylvania State University shall apply the 15 moneys appropriated by this act only for such purposes as are 16 permitted in this act and shall at all times maintain proper 17 records showing the application of such moneys. Not later than 18 one hundred twenty days after the close of the fiscal year to 19 which this act relates, the Pennsylvania State University shall 20 file with the Secretary of Education, the General Assembly, and 21 with the Auditor General of the Commonwealth, a statement 22 setting forth the amounts and purposes of all expenditures made 23 from moneys appropriated by this act and other university 24 accounts during said fiscal year, the number of full-time 25 equivalent students enrolled in the Doctor of Medicine program 26 and net costs, as provided in sections 2 and 3 of this act, used 27 as a basis for receipt of any appropriation during said fiscal 28 year. 29 Such statement of expenditures and number of full-time 30 equivalent students enrolled in the Doctor of Medicine program 19730H0999B1754 - 3 -
1 and net costs shall be reviewed by the Auditor General of the 2 Commonwealth, and he shall have the right, in respect to the 3 moneys appropriated by this act, to audit and disallow 4 expenditures made for purposes not permitted by this act and to 5 cause such sums to be recovered and paid by the Pennsylvania 6 State University to the Treasurer of the Commonwealth. The 7 Auditor General shall also make a determination of full-time 8 equivalent students enrolled in the Doctor of Medicine program 9 and net costs and make a certification as to their correctness. 10 In respect to expenditures made by the university from moneys 11 other than those appropriated by this act, the Auditor General 12 shall have the right to review only and he shall file annually 13 with the General Assembly such information concerning such 14 expenditures as the General Assembly or any of its committees 15 may require. 16 SECTION 6. A REPORT TWO REPORTS SHALL BE SUBMITTED TO THE <-- 17 GOVERNOR AND THE APPROPRIATIONS AND EDUCATION COMMITTEES OF THE 18 SENATE AND HOUSE OF REPRESENTATIVES PRIOR TO MARCH 31, 1974 <-- 19 WHICH AND SHALL INCLUDE DATA FOR ALL PROGRAMS OF THE UNIVERSITY 20 EXCEPT THE DOCTOR OF MEDICINE PROGRAM. THE FOLLOWING: <-- 21 (1) FOR THOSE TERMS OF 1973-1974 WHICH HAVE BEEN COMPLETED 22 AND ESTIMATES FOR THE REMAINING TERMS OF 1973-1974: THE FIRST 23 REPORT, TO BE SUBMITTED PRIOR TO DECEMBER 1, 1973, SHALL COVER 24 THE PERIOD FROM JUNE 25, 1973 TO AUGUST 18, 1973. THE SECOND 25 REPORT, TO BE SUBMITTED PRIOR TO NOVEMBER 1, 1974, SHALL COVER 26 THE TWELVE-MONTH PERIOD BEGINNING SEPTEMBER 1, 1973. EACH REPORT 27 SHALL INCLUDE FOR EACH TERM DURING THE PERIOD: 28 (1) THE FOLLOWING COUNTS AND DISTRIBUTIONS: 29 (I) THE DEFINITIONS AND NUMBERS OF FULL-TIME FACULTY 30 MEMBERS, OF PART-TIME FACULTY MEMBERS CATEGORIZED AS HALF-TIME, <-- 19730H0999B1754 - 4 -

1 AVERAGE HOURS PER WEEK SPENT IN UNIVERSITY-RELATED ACTIVITIES 2 FOR EACH FULL-TIME FACULTY MEMBER IDENTIFIED BY SCHOOL, 3 DEPARTMENT AND TITLE. 4 SECTION 7. IN ADDITION TO THE REQUIREMENTS OF SECTION 6, THE 5 REPORT COVERING THE TWELVE-MONTH PERIOD BEGINNING SEPTEMBER 1, 6 1973 SHALL INCLUDE FOR ALL PROGRAMS OF THE UNIVERSITY EXCEPT THE 7 DOCTOR OF MEDICINE PROGRAM: 8 (1) MINIMUM NUMBER OF CREDITS REQUIRED FOR A BACCALAUREATE 9 DEGREE, AND FOR A MASTER'S DEGREE. 10 (2) NUMBER OF BACHELOR'S DEGREES, MASTER'S DEGREES, FIRST 11 PROFESSIONAL DEGREES, AND DOCTORAL DEGREES AWARDED IN 1971, 12 1972, 1973, AND ESTIMATED 1974. 13 Section 6.7 8. The Pennsylvania State University shall <-- 14 report its revenues and expenditures and present its financial 15 statements required under the provisions of this act in 16 accordance with generally accepted accounting principles and 17 procedures for educational institutions as set forth in "College 18 and University Business Administration" of the American Council 19 on Education, Revised Edition, 1968, without exception. 20 Section 7.8. 9.
