           SEPTEMBER 18, 1973

                                  A SUPPLEMENT

     1  To the act of April 1, 1863 (P.L.213, No.227), entitled "An act
     2     to accept the grant of Public Lands, by the United States, to
     3     the several states, for the endowment of Agricultural
     4     Colleges," making appropriations for carrying the same into
     5     effect, providing for a basis for payments of such
     6     appropriations and providing a method of accounting for the
     7     funds appropriated.

     8     The General Assembly of the Commonwealth of Pennsylvania
     9  hereby enacts as follows:
    10     Section 1.  In order to carry into effect the act of
    11  Congress, approved July 2, 1862, granting public land to the
    12  several states for educational purposes, and subsequent acts of
    13  Congress related thereto, and the act of the General Assembly of
    14  Pennsylvania accepting the provisions and conditions of said
    15  acts of Congress and pledging the faith of the State to carry
    16  the same into effect, the following sums or as much thereof as
    17  may be necessary are hereby specifically appropriated to the
    18  Trustees of the Pennsylvania State University for the fiscal
    19  year July 1, 1973 to June 30, 1974, for the purposes and in the
    20  amounts as shown:

     1     (1)  For net cost of instruction AND STUDENT                   <--

    14     Section 2.  Payments to Pennsylvania State University on
    15  account of the appropriations for all items as provided in
    16  section 1 of this act except for instruction - Doctor of
    17  Medicine shall be made on the basis of net costs during the
    18  fiscal year.
    19     Payments for instruction - Doctor of Medicine shall be made
    20  on the basis of full-time equivalent students enrollment at the
    21  rate of seven thousand four hundred sixty-five dollars ($7,465)
    22  per student.
    23     Section 3.  If necessary, the Pennsylvania State University
    24  may transfer funds among the appropriations listed in section 1,
    25  clauses (1), (2) AND (3), (4) and (5): Provided, That the         <--
    26  aggregate amount transferred into or out of each appropriation
    27  during the fiscal year shall not exceed ten per cent of the
    28  amount specifically appropriated for that purpose.
    29     Section 4.  Payments to the Pennsylvania State University of
    30  the appropriations herein provided shall be made quarterly        <--

     1  MONTHLY during the fiscal year. as follows:                       <--
     2     (1)  First payment on September 30, 1973.
     3     (2)  Second payment on December 31, 1973.
     4     (3)  Third payment on March 31, 1974.
     5     (4)  Fourth payment on June 30, 1974.
     6     Such quarterly MONTHLY payments shall be made in accordance    <--
     7  with the provisions of sections 2 and 3 of this act, on the
     8  basis of estimated net costs and full-time equivalent students
     9  enrolled in the Doctor of Medicine program. The estimate of net
    10  costs shall be submitted by the Pennsylvania State University to
    11  the Secretary of Education, the General Assembly and to the
    12  State Treasurer not later than thirty days prior to the date on
    13  which such payment is to be made.
    14     Section 5.  The Pennsylvania State University shall apply the
    15  moneys appropriated by this act only for such purposes as are
    16  permitted in this act and shall at all times maintain proper
    17  records showing the application of such moneys. Not later than
    18  one hundred twenty days after the close of the fiscal year to
    19  which this act relates, the Pennsylvania State University shall
    20  file with the Secretary of Education, the General Assembly, and
    21  with the Auditor General of the Commonwealth, a statement
    22  setting forth the amounts and purposes of all expenditures made
    23  from moneys appropriated by this act and other university
    24  accounts during said fiscal year, the number of full-time
    25  equivalent students enrolled in the Doctor of Medicine program
    26  and net costs, as provided in sections 2 and 3 of this act, used
    27  as a basis for receipt of any appropriation during said fiscal
    28  year.
    29     Such statement of expenditures and number of full-time
    30  equivalent students enrolled in the Doctor of Medicine program

     1  and net costs shall be reviewed by the Auditor General of the
     2  Commonwealth, and he shall have the right, in respect to the
     3  moneys appropriated by this act, to audit and disallow
     4  expenditures made for purposes not permitted by this act and to
     5  cause such sums to be recovered and paid by the Pennsylvania
     6  State University to the Treasurer of the Commonwealth. The
     7  Auditor General shall also make a determination of full-time
     8  equivalent students enrolled in the Doctor of Medicine program
     9  and net costs and make a certification as to their correctness.
    10  In respect to expenditures made by the university from moneys
    11  other than those appropriated by this act, the Auditor General
    12  shall have the right to review only and he shall file annually
    13  with the General Assembly such information concerning such
    14  expenditures as the General Assembly or any of its committees
    15  may require.
    16     SECTION 6.  A REPORT SHALL BE SUBMITTED TO THE GOVERNOR AND    <--
    17  THE APPROPRIATIONS AND EDUCATION COMMITTEES OF THE SENATE AND
    18  HOUSE OF REPRESENTATIVES PRIOR TO MARCH 31, 1974 WHICH SHALL
    19  INCLUDE FOR ALL PROGRAMS OF THE UNIVERSITY EXCEPT THE DOCTOR OF
    20  MEDICINE PROGRAM THE FOLLOWING:
    21     (1)  FOR THOSE TERMS OF 1973-1974 WHICH HAVE BEEN COMPLETED
    22  AND ESTIMATES FOR THE REMAINING TERMS OF 1973-1974:
    23     (I)  THE DEFINITIONS AND NUMBERS OF FULL-TIME FACULTY
    24  MEMBERS, OF PART-TIME FACULTY MEMBERS CATEGORIZED AS HALF-TIME,
    25  ONE-THIRD TIME, AND ONE-FOURTH TIME FACULTY MEMBERS, OF FULL-
    26  TIME STUDENTS ENROLLED IN GRADUATE COURSES, OF FULL-TIME
    27  STUDENTS ENROLLED IN UNDERGRADUATE COURSES, AND OF PART-TIME
    28  STUDENTS ENROLLED IN GRADUATE COURSES, AND OF PART-TIME STUDENTS
    29  ENROLLED IN UNDERGRADUATE COURSES;
    30     (II)  TOTAL NUMBERS OF UNDERGRADUATE STUDENT CREDITS AND OF

     1  GRADUATE STUDENT CREDITS;
     2     (III)  NUMBER OF DIFFERENT COURSES SCHEDULED, DISTRIBUTED BY
     3  THE NUMBER OF SECTIONS SCHEDULED IN EACH COURSE AND THE SECTIONS
     4  DISTRIBUTED BY THE NUMBER OF STUDENTS ENROLLED IN EACH SECTION;
     5     (IV)  NUMBER OF TERMS SCHEDULED IN THE FISCAL YEAR AND THE
     6  DATES THEREOF;
     7     (V)  MINIMUM NUMBER OF CREDITS REQUIRED FOR A BACCALAUREATE
     8  DEGREE, AND FOR A MASTER'S DEGREE;
     9     (VI)  NUMBER OF BACHELOR'S DEGREES, MASTER'S DEGREES, FIRST
    10  PROFESSIONAL DEGREES, AND DOCTORAL DEGREES AWARDED IN 1971,
    11  1972, 1973, AND ESTIMATED 1974.
    12     (2)  FOR THOSE TERMS OF 1973-1974 WHICH HAVE BEEN COMPLETED
    13  AND ESTIMATES FOR THE REMAINING TERMS OF 1973-1974 A
    14  CLASSIFICATION OF FACULTY MEMBERS BY FULL-TIME, PART-TIME; AND
    15  BY ASSIGNMENTS IN UNDERGRADUATE COURSES ONLY, GRADUATE COURSES
    16  ONLY, BOTH GRADUATE AND UNDERGRADUATE COURSES; AND BY TITLE SUCH
    17  AS PROFESSOR, ASSOCIATE PROFESSOR, ASSISTANT PROFESSOR,
    18  INSTRUCTOR, LECTURER, RESEARCH ASSOCIATE, AND THE FOLLOWING
    19  AGGREGATES FOR EACH CLASSIFICATION:
    20     (I)  THE NUMBER IN EACH CLASSIFICATION;
    21     (II)  THE SUM OF CREDITS ASSIGNED TO UNDERGRADUATE COURSES
    22  TAUGHT BY ALL FACULTY MEMBERS IN EACH CLASSIFICATION;
    23     (III)  THE SUM OF CREDITS ASSIGNED TO GRADUATE COURSES TAUGHT
    24  BY ALL FACULTY MEMBERS IN EACH CLASSIFICATION;
    25     (IV)  THE SUM OF UNDERGRADUATE STUDENT CREDITS AND THE SUM OF
    26  GRADUATE STUDENT CREDITS GENERATED BY ALL FACULTY MEMBERS IN
    27  EACH CLASSIFICATION;
    28     (V)  TOTAL SALARY PAID TO ALL FACULTY MEMBERS IN EACH
    29  CLASSIFICATION;
    30     (VI)  TOTAL SALARY PAID FROM FEDERAL FUNDS TO ALL FACULTY

     1  MEMBERS IN EACH CLASSIFICATION;
     2     (VII)  TOTAL SALARY PAID FROM UNIVERSITY FUNDS TO ALL FACULTY
     3  MEMBERS IN EACH CLASSIFICATION.
     4     (3)  FOR THE FISCAL YEAR 1973-1974 IDENTIFY BY SCHOOL,
     5  DEPARTMENT, AND TITLE EACH FULL-TIME FACULTY MEMBER AND PROVIDE
     6  THE NUMBER OF CONTACT HOURS ASSIGNED TO HIM PER WEEK DURING EACH
     7  TERM, THE AVERAGE NUMBER OF HOURS PER WEEK SPENT BY HIM ON
     8  ACADEMIC PREPARATION, AND THE TOTAL AVERAGE NUMBER OF HOURS PER
     9  WEEK SPENT BY HIM ON UNIVERSITY RELATED WORK.
    10     Section 6. 7.  The Pennsylvania State University shall report  <--
    11  its revenues and expenditures and present its financial
    12  statements required under the provisions of this act in
    13  accordance with generally accepted accounting principles and
    14  procedures for educational institutions as set forth in "College
    15  and University Business Administration" of the American Council
    16  on Education, Revised Edition, 1968, without exception.
    17     Section 7. 8.  This act shall take effect July 1, 1973         <--
