                                     AN ACT

     1  Amending the act of April 29, 1959 (P.L.58), entitled "An act
     2     consolidating and revising the Vehicle Code, the Tractor
     3     Code, the Motor Vehicle Financial Responsibility Act and
     4     other acts relating to the ownership, possession and use of
     5     vehicles and tractors," further defining bases for revocation
     6     of operating privileges.

     7     The General Assembly of the Commonwealth of Pennsylvania
     8  hereby enacts as follows:
     9     Section 1.  Clause (1) of subsection (a) of section 616, act
    10  of April 29, 1959 (P.L.58), known as "The Vehicle Code," is
    11  amended to read:
    12     Section 616.  Revocation of Operating Privilege.--
    13     (a)  Upon receiving a certified record, from the clerk of the
    14  court, of proceedings in which a person pleaded guilty, entered
    15  a plea of nolo contendere, or was found guilty by a judge or
    16  jury, of any of the crimes enumerated in this section, the
    17  secretary shall forthwith revoke, for a period of one (1) year
    18  from the date of revocation, the operating privilege of any such
    19  person: Provided, however, That if such person is serving or has
    20  served a period of suspension for the same offense under the


     1  provisions of clause (1) of subsection (b) of section 618 of
     2  this act, he shall be credited with the suspension time served
     3  against the one (1) year revocation, and where such person was
     4  convicted, or entered a plea of guilty or nolo contendere, of
     5  any one of the crimes enumerated in this section, such operating
     6  privilege shall not be restored, unless and until the fine and
     7  costs, imposed in such cases, have been fully paid. The clerk of
     8  the courts shall, when such fine and costs have been so paid in
     9  any such case, certify such fact to the Department of Revenue.
    10  Bases requiring such certification follow:
    11     (1)  Operating a motor vehicle or tractor while under the
    12  influence of intoxicating liquor, or any narcotic or [habit
    13  producing] dangerous drug, or permitting any person, who may be
    14  under the influence of intoxicating liquor or narcotic or [habit
    15  producing] dangerous drug, to operate any motor vehicle or
    16  tractor owned by him or in his custody or control.
