AN ACT

 

1Amending the act of June 3, 1937 (P.L.1333, No.320), entitled
2"An act concerning elections, including general, municipal,
3special and primary elections, the nomination of candidates,
4primary and election expenses and election contests; creating
5and defining membership of county boards of elections;
6imposing duties upon the Secretary of the Commonwealth,
7courts, county boards of elections, county commissioners;
8imposing penalties for violation of the act, and codifying,
9revising and consolidating the laws relating thereto; and
10repealing certain acts and parts of acts relating to
11elections," in county boards of election, further providing
12for membership.

13The General Assembly of the Commonwealth of Pennsylvania
14hereby enacts as follows:

15Section 1. Section 301(c) of the act of June 3, 1937
16(P.L.1333, No.320), known as the Pennsylvania Election Code,
17amended June 10, 1982 (P.L.458, No.135), is amended to read:

18Section 301. County Boards of Elections; Membership.--

20(c) Whenever a member of the board of county commissioners
21is a candidate for nomination or election to any public office,
22the President Judge of the Court of Common Pleas shall appoint a
23judge or an elector of the county who is a registered and
 

1enrolled member of the same political party as such member of 
2the board of county commissioners to serve in his stead.
3Whenever there appears on the ballot a question relating to the
4adoption of a Home Rule Charter for the county or amendments to
5an existing county Home Rule Charter, the President Judge of the
6Court of Common Pleas shall appoint judges or electors of the
7county to serve in the stead of the county commissioners. Each 
8judge or elector shall be a registered and enrolled member of 
9the same political party as such member of the board of county 
10commissioners for whom he is appointed to serve. Appointees who
11are not currently elected office holders shall receive
12compensation for such service as determined by the salary board
13plus mileage as specified by the county for expenses incurred
14when performing election board business.

15Section 2. This act shall take effect in 60 days.
