        INTRODUCED BY BRIGHTBILL, HART, HOPPER, BORTNER, SHAFFER, LYNCH,
           JONES, WENGER, O'PAKE, REIBMAN, SALVATORE, MUSTO, CORMAN,
           GREENWOOD, SHUMAKER, ROBBINS, JUBELIRER, LOEPER, STOUT,
           SCHWARTZ, FISHER, TILGHMAN, LAVALLE, BELAN, AFFLERBACH AND
           RHOADES, AUGUST 19, 1991

        AS AMENDED ON THIRD CONSIDERATION, HOUSE OF REPRESENTATIVES,
           NOVEMBER 24, 1992

                                     AN ACT

     1  Designating May 15th as "Peace Officers Memorial Day" in
     2     Pennsylvania; designating that week of May during which May
     3     15th occurs as "Police Week" in Pennsylvania; DESIGNATING THE  <--
     4     SUNDAY DURING FIRE PREVENTION WEEK AS "FIREFIGHTERS' MEMORIAL
     5     SUNDAY"; and requiring that the flags of the United States
     6     and this Commonwealth be flown at half-mast on May 15th.

     7     WHEREAS, Law enforcement is one of the most essential          <--
     8  services provided to the citizens of our great Nation; and
     9     WHEREAS, The peace officers of our Nation serve the citizens
    10  of their communities with dedication and integrity; and
    11     WHEREAS, These men and women stand guard in our midst, night
    12  and day, to protect us through enforcement of our laws; and
    13     WHEREAS, The devotion and intrepidity of our Nation's peace
    14  officers and the sacrifices of officers who have been killed in
    15  the line of duty should not go unrecognized; and
    16     WHEREAS, Public Law 87-726, 36 U.S.C. § 167, authorizes the
    17  President to designate May 15th of each year as "Peace Officers


     1  Memorial Day."
     2     The General Assembly of the Commonwealth of Pennsylvania
     3  hereby enacts as follows:
     4  SECTION 1.  POLICE OFFICERS MEMORIAL.                             <--
     5     (A)  FINDINGS.--THE GENERAL ASSEMBLY HEREBY FINDS THAT:
     6         (1)  LAW ENFORCEMENT IS ONE OF THE MOST ESSENTIAL
     7     SERVICES PROVIDED TO THE CITIZENS OF OUR GREAT NATION.
     8         (2)  THE PEACE OFFICERS OF OUR NATION SERVE THE CITIZENS
     9     OF THEIR COMMUNITIES WITH DEDICATION AND INTEGRITY.
    10         (3)  THESE MEN AND WOMEN STAND GUARD IN OUR MIDST, NIGHT
    11     AND DAY, TO PROTECT US THROUGH ENFORCEMENT OF OUR LAWS.
    12         (4)  THE DEVOTION AND INTREPIDITY OF OUR NATION'S PEACE
    13     OFFICERS AND THE SACRIFICES OF OFFICERS WHO HAVE BEEN KILLED
    14     IN THE LINE OF DUTY SHOULD NOT GO UNRECOGNIZED.
    15         (5)  PUBLIC LAW 87-726, 36 U.S.C. § 167, AUTHORIZES THE
    16     PRESIDENT TO DESIGNATE MAY 15TH OF EACH YEAR AS "PEACE
    17     OFFICERS MEMORIAL DAY."
    18  Section 1.  Peace Officers Memorial Day; Police Week.             <--
    19     (B)  PEACE OFFICERS MEMORIAL DAY; POLICE WEEK.--May 15th is    <--
    20  designated as "Peace Officers Memorial Day" in Pennsylvania in
    21  honor of peace officers who have been killed in the line of duty
    22  and designate that week of May during which May 15th occurs as
    23  "Police Week" in Pennsylvania in recognition of our country's
    24  courageous peace officers.
    25  Section 2.  Display of flags.                                     <--
    26     (C)  DISPLAY OF FLAGS.--The flag of the United States and the  <--
    27  flag of this Commonwealth shall be flown at half-mast from all
    28  public grounds and buildings of this Commonwealth on May 15th to
    29  honor peace officers who lost their lives in the line of duty.
    30  SECTION 2.  FIREFIGHTERS' MEMORIAL.                               <--

     1     (A)  GENERAL RULE.--THE SUNDAY WHICH MARKS THE BEGINNING OF
     2  FIRE PREVENTION WEEK OF EVERY YEAR IS DESIGNATED AS
     3  "FIREFIGHTERS' MEMORIAL SUNDAY" TO HONOR PAID AND VOLUNTEER
     4  FIREFIGHTERS WHO HAVE DIED DURING THE PREVIOUS YEAR, EITHER IN
     5  THE LINE OF DUTY OR OF NATURAL CAUSES OR OFF-DUTY ACCIDENT.
     6     (B)  EXCEPTION.--IF FIRE PREVENTION WEEK BEGINS ON A DAY
     7  OTHER THAN SUNDAY, THE SUNDAY WHICH FALLS WITHIN FIRE PREVENTION
     8  WEEK IS DESIGNATED AS "FIREFIGHTERS' MEMORIAL SUNDAY."
     9  Section 3.  Effective date.
    10     This act shall take effect in 60 days.
