| AN ACT |
| |
1 | Amending Titles 53 (Municipalities Generally) and 75 (Vehicles) |
2 | of the Pennsylvania Consolidated Statutes, providing for the |
3 | Municipal Police Recruitment and Retention Program and for |
4 | law enforcement enhancement surcharge. |
5 | The General Assembly of the Commonwealth of Pennsylvania |
6 | hereby enacts as follows: |
7 | Section 1. Title 53 of the Pennsylvania Consolidated |
8 | Statutes is amended by adding a section to read: |
9 | § 2172. Municipal Police Recruitment and Retention Program. |
10 | (a) Establishment.--There is hereby established in the State |
11 | Treasury the Municipal Police Recruitment and Retention Program |
12 | Fund as a special, nonlapsing fund. Moneys in the fund shall be |
13 | expended for the purposes set forth in this section. |
14 | (b) Administration.--The commission shall administer the |
15 | fund and make grants from the fund for recruitment and retention |
16 | of a municipality's part-time police force in accordance with |
17 | this section. |
18 | (c) Purpose of grants.--Grants shall be for the purpose of |
19 | hiring and retaining part-time police officers in a municipality |

1 | and shall be used to pay a portion of the salary of a part-time |
2 | police officer. Grants shall not exceed $5,000 per police |
3 | officer position and shall be used to supplement the part-time |
4 | police officer's salary paid by the municipality up to a maximum |
5 | of $15 per hour of pay, not to exceed 85% of a full-time base |
6 | salary for a police officer in the municipality. The rate shall |
7 | be calculated based on average salaries for 2011 as adjusted |
8 | annually by the Consumer Price Index for the metropolitan area |
9 | in which the municipality is located. |
10 | (d) Other funds.--In addition to the moneys available in the |
11 | fund, any appropriation for municipal police officer training |
12 | that remains as part of the Municipal Police Officers' Training |
13 | Commission prior to lapsing, shall be deposited in the fund |
14 | beginning with the current fiscal year, for the purposes |
15 | contained in this section. |
16 | (e) Regulations.--The commission shall promulgate rules and |
17 | regulations to implement and administer the provisions of this |
18 | section within 90 days of the effective date of this section. |
19 | (f) Definitions.--As used in this section, the following |
20 | words and phrases shall have the meaning given to them in this |
21 | subsection unless the context clearly indicates otherwise: |
22 | "Fund." The Municipal Police Recruitment and Retention |
23 | Program Fund established under 75 Pa.C.S. § 6508 (relating to |
24 | law enforcement enhancement surcharge). |
25 | "Municipality." A city of the third class, borough, township |
26 | of the first class or township of the second class that provides |
27 | local police services through a municipal police department, |
28 | participation in a regional police department or contracts with |
29 | other municipal or regional police. |
30 | Section 2. Title 75 is amended by adding a section to read: |

1 | § 6508. Law enforcement enhancement surcharge. |
2 | (a) Levy and imposition.--In addition to any fines, fees or |
3 | penalties levied or imposed as provided by law under this title |
4 | or any other statute, a surcharge shall be levied for |
5 | disposition in accordance with subsection (b). Upon conviction |
6 | for any violation of the provisions of this title or other |
7 | statute of this Commonwealth, or regulations promulgated under |
8 | this title, which is a traffic violation, exclusive of parking |
9 | offenses, a surcharge of $10 shall be levied. |
10 | (b) Disposition.--Notwithstanding the provisions of 42 |
11 | Pa.C.S. §§ 3571 (relating to Commonwealth portion of fines, |
12 | etc.) and 3573 (relating to municipal corporation portion of |
13 | fines, etc.) all surcharges levied and collected under |
14 | subsection (a) by any division of the unified judicial system |
15 | existing under section 1 of Article V of the Constitution of |
16 | Pennsylvania and 42 Pa.C.S. § 301 (relating to unified judicial |
17 | system) shall be remitted to the Commonwealth for deposit in the |
18 | Municipal Police Recruitment and Retention Program Fund, |
19 | established under 53 Pa.C.S. § 2172 (relating to Municipal |
20 | Police Recruitment and Retention Program), for the purpose of |
21 | recruiting and retaining municipal police officers. |
22 | Section 3. This act shall take effect in 60 days. |
