AN ACT
1Amending the act of December 27, 1974 (P.L.995, No.326),
2entitled "An act regulating the practice of veterinary
3medicine and imposing penalties," further providing for
4grounds for disciplinary proceedings.
5The General Assembly of the Commonwealth of Pennsylvania
6hereby enacts as follows:
7Section 1. Section 21(11) of the act of December 27, 1974
8(P.L.995, No.326), known as the Veterinary Medicine Practice
9Act, amended December 9, 2002 (P.L.1370, No.167), is amended to
10read:
11Section 21. Grounds for Disciplinary Proceedings.--The board
12shall suspend or revoke any license or certificate or otherwise
13discipline an applicant, licensee or certificate holder who is
14found guilty by the board or by a court of one or more of the
15following:

17(11) Incompetence, gross negligence or other malpractice, or
18the departure from, or failure to conform to, the standards of
1acceptable and prevailing veterinary medical practice, in which
2case actual injury need not be established. Failure of a
3licensee to perform prescreening of an animal, such as
4conducting a blood test, prior to use of a drug, if the
5prescreening is recommended by the drug manufacturer, may be
6evidence in a disciplinary action at the discretion of the
7board. The board may consider the withholding of consent for any
8prescreening by the animal owner.

10Section 2. This act shall take effect in 60 days.
