AN ACT

 

1Amending the act of May 17, 1921 (P.L.682, No.284), entitled "An
2act relating to insurance; amending, revising, and
3consolidating the law providing for the incorporation of
4insurance companies, and the regulation, supervision, and
5protection of home and foreign insurance companies, Lloyds
6associations, reciprocal and inter-insurance exchanges, and
7fire insurance rating bureaus, and the regulation and
8supervision of insurance carried by such companies,
9associations, and exchanges, including insurance carried by
10the State Workmen's Insurance Fund; providing penalties; and
11repealing existing laws," further providing for reimbursement
12for diabetic supplies.

13The General Assembly of the Commonwealth of Pennsylvania
14hereby enacts as follows:

15Section 1. Section 634(a) of the act of May 17, 1921
16(P.L.682, No.284), known as The Insurance Company Law of 1921,
17added October 16, 1998 (P.L.784, No.98), is amended to read:

18Section 634. Reimbursement for Diabetic Supplies.--(a)
19Except to the extent already covered under another policy, any
20individual or group health, sickness and accident insurance
21policy, group health insurance plans/policies, and all other
22forms of managed/capitated care plans/policies or subscriber
23contract or certificate issued by any entity subject to 40

1Pa.C.S. Ch. 61 (relating to hospital plan corporations) or 63
2(relating to professional health services plan corporations) or
3the act of December 29, 1972 (P.L.1701, No.364), known as the
4"Health Maintenance Organization Act," [the act of December 14,
51992 (P.L.835, No.134), known as the "Fraternal Benefit
6Societies Code,"] or this act providing hospital or
7medical/surgical coverage shall provide coverage of the
8equipment, supplies, medication and outpatient self-management
9training and education, including medical nutrition therapy for
10the treatment of insulin-dependent diabetes, insulin-using
11diabetes, gestational diabetes [and], non-insulin-using diabetes
12and the treatment of pain associated with complications of 
13diabetes, such as diabetic peripheral neuropathy and other 
14comorbid conditions, if prescribed by a health care professional
15legally authorized to prescribe such items under law. The
16benefits specified in this section may be provided through a
17combination of policies, contracts, certificates or riders,
18including major medical contracts.
