AN ACT

 

1Amending the act of March 10, 1949 (P.L.30, No.14), entitled "An
2act relating to the public school system, including certain
3provisions applicable as well to private and parochial
4schools; amending, revising, consolidating and changing the
5laws relating thereto," in pupils and attendance, further
6providing for cost of tuition and maintenance of certain
7exceptional children in approved institutions and for actual
8cost of tuition and maintenance of certain exceptional
9children in the four chartered schools for education of the
10deaf and the blind.

11The General Assembly of the Commonwealth of Pennsylvania
12hereby enacts as follows:

13Section 1. Sections 1376(a.2)(1) and 1376.1(b.2)(1) of the
14act of March 10, 1949 (P.L.30, No.14), known as the Public
15School Code of 1949, amended July 4, 2004 (P.L.536, No.70), are
16amended to read:

17Section 1376. Cost of Tuition and Maintenance of Certain
18Exceptional Children in Approved Institutions.--* * *

19(a.2) For the 2005-2006 school year and each school year
20thereafter, the Department of Education shall determine the
21payment amount for each approved private school for all students

1enrolled in an approved private school for the prior school year
2as follows:

3(1) (i) Multiply the payment determined for the immediate
4preceding school year by one hundred and twenty-five percent
5(125%) of the percentage increase in the appropriation for
6special education for the fiscal year prior to the fiscal year
7in which payments under this subsection are made.

8(ii) Add the product from subparagraph (i) to the payment
9determined for the immediate preceding school year.

10(iii) In any fiscal year in which there is no increase in
11the State appropriation for special education, the increase for
12the approved private schools in any following fiscal year shall
13be calculated by applying the multiplier in subparagraph (i) to
14the percentage increase in the appropriation of the approved
15private schools from the last fiscal year in which there was an
16increase in the approved private schools' State appropriations.

18Section 1376.1. Actual Cost of Tuition and Maintenance of
19Certain Exceptional Children in the Four Chartered Schools for
20Education of the Deaf and the Blind.--* * *

21(b.2) Payments are as follows:

22(1) For the 2005-2006 school year and each school year
23thereafter, the department shall determine the payment amount
24for each chartered school for all students enrolled in a
25chartered school for the prior school year as follows:

26(i) Multiply the payment determined for the immediate
27preceding school year by one hundred and twenty-five percent
28(125%) of the percentage increase in the appropriation for
29special education for the fiscal year prior to the fiscal year
30in which payments under this subsection are made.

1(ii) Add the product under subparagraph (i) to the payment
2determined for the immediately preceding school year.

3(iii) In any fiscal year in which there is no increase in
4the State appropriation for special education, the increase for
5the chartered schools for the deaf and blind in any following
6fiscal year shall be calculated by applying the multiplier in
7subparagraph (i) to the percentage increase in the appropriation
8of the chartered schools from the last fiscal year in which
9there was an increase in the chartered schools' State
10appropriations.

12Section 2. This act shall take effect in 60 days.
