                                     AN ACT

     1  Amending Title 18 (Crimes and Offenses) of the Pennsylvania
     2     Consolidated Statutes, providing for an offense relating to
     3     fabricated airbags and fabricated airbag compartments.

     4     The General Assembly of the Commonwealth of Pennsylvania
     5  hereby enacts as follows:
     6     Section 1.  Title 18 of the Pennsylvania Consolidated
     7  Statutes is amended by adding a section to read:
     8  § 7331.  Fabricated airbags and fabricated airbag compartments.
     9     (a)  Offense defined.--It is unlawful for any person to
    10  knowingly purchase, sell, install or reinstall on a vehicle a
    11  fabricated airbag or fabricated airbag compartment.
    12     (b)  Grading.--Any person who violates subsection (a) commits
    13  a misdemeanor of the first degree.
    14     (c)  Definitions.--As used in this section, the following
    15  words and phrases shall have the meanings given to them in this
    16  subsection:
    17     "Fabricated airbag."  Any item, other than an airbag designed

     1  in accordance with Federal safety regulations for a given make,
     2  model and year of motor vehicle that is part of a motor vehicle
     3  inflatable restraint system.
     4     "Fabricated airbag compartment."  An airbag compartment that
     5  is filled with any substance that does not function in the same
     6  manner or to the same extent as an airbag designed in accordance
     7  with Federal safety regulations for a given make, model and year
     8  of motor vehicle to protect vehicle occupants in a vehicle
     9  crash. The term does not include a compartment from which an
    10  airbag has deployed if there is no concealment of the
    11  deployment.
    12     Section 2.  This act shall take effect in 60 days.
