1Amending Title 75 (Vehicles) of the Pennsylvania Consolidated
2Statutes, in accidents and accident reports, further
3providing for duty to give information and render aid.

4The General Assembly of the Commonwealth of Pennsylvania
5hereby enacts as follows:

6Section 1. Section 3744(c) of Title 75 of the Pennsylvania
7Consolidated Statutes is amended and the section is amended by
8adding a subsection to read:

9§ 3744. Duty to give information and render aid.

11(c) Duty of occupants [if driver disabled].--Whenever the
12driver of a vehicle is physically unable, refuses or neglects to
13give the information or assistance required in this section and
14there are other occupants in the vehicle at the time of the
15accident who are physically able to give the information or
16assistance required in this section, each of the other occupants
17shall fully reveal the identity of himself and the identity of
18the driver of the vehicle and of the owner of the vehicle of

1which they are occupants and shall otherwise perform the duties
2of the driver as set forth in subsection (a).

3(d) Penalties.--

4(1) Any driver violating this section commits a
5misdemeanor of the third degree and shall, upon conviction,
6be sentenced to pay a fine of not more than $2,500.

7(2) Any occupant violating this section commits a
8summary offense and shall, upon conviction, be sentenced to
9pay a fine of not more than $300.

10Section 2. This act shall take effect in 60 days.
