AN ACT 1 Amending the act of May 29, 1945 (P.L.1134, No.405), entitled 2 "An act to create a commission to act jointly with 3 commissions appointed for like purpose by the States of West 4 Virginia and Maryland, the Commonwealth of Virginia and the 5 District of Columbia, which, together with three members to 6 be appointed by the President of the United States, shall 7 constitute the Interstate Commission on the Potomac River 8 Basin, with power to cooperate in the abatement of the 9 existing pollution, and in the control of future pollution of 10 the waters of the drainage basin of the Potomac River within 11 the States of Maryland and West Virginia, the Commonwealth of 12 Virginia and the District of Columbia; to authorize the 13 Governor of the State to execute on behalf of this State a 14 compact with representatives of other states for the purpose 15 of forming the above-mentioned commission; and creating a 16 Potomac Valley Conservancy District; providing for the 17 appointment of the Pennsylvania members of said commission 18 for the Commonwealth of Pennsylvania, and their terms of 19 office; and providing an appropriation," further providing 20 for the members of the Interstate Commission on the Potomac 21 River Basin for the Commonwealth. 22 The General Assembly of the Commonwealth of Pennsylvania 23 hereby enacts as follows: 24 Section 1. Sections 1 first paragraph and 1.1 of the act of 25 May 29, 1945 (P.L.1134, No.405), entitled "An act to create a 26 commission to act jointly with commissions appointed for like
1 purpose by the States of West Virginia and Maryland, the 2 Commonwealth of Virginia and the District of Columbia, which, 3 together with three members to be appointed by the President of 4 the United States, shall constitute the Interstate Commission on 5 the Potomac River Basin, with power to cooperate in the 6 abatement of the existing pollution, and in the control of 7 future pollution of the waters of the drainage basin of the 8 Potomac River within the States of Maryland and West Virginia, 9 the Commonwealth of Virginia and the District of Columbia; to 10 authorize the Governor of the State to execute on behalf of this 11 State a compact with representatives of other states for the 12 purpose of forming the above-mentioned commission; and creating 13 a Potomac Valley Conservancy District; providing for the 14 appointment of the Pennsylvania members of said commission for 15 the Commonwealth of Pennsylvania, and their terms of office; and 16 providing an appropriation," amended or added April 28, 1961 17 (P.L.113, No.51), are amended to read: 18 Section 1. There is hereby created a commission consisting 19 of three members, to act jointly with commissions appointed for 20 like purposes by the States of West Virginia and Maryland, the 21 Commonwealth of Virginia and the District of Columbia, and an 22 additional three members to be appointed by the President of the 23 United States and which, together with the other commissions 24 appointed as hereinbefore mentioned, shall constitute and be 25 known as the Interstate Commission on the Potomac River Basin. 26 The said commission for the Commonwealth of Pennsylvania shall 27 consist of three members [to]. Two members shall be named by the 28 Governor[, one of whom]. One appointed member shall be [from the 29 membership of the Pennsylvania Commission on Interstate 30 Cooperation, and one of whom shall be a representative of the 19930S0333B1210 - 2 -
1 Sanitary Water Board, and one of whom] a member of the public 2 knowledgeable in matters involving water pollution and the other 3 member shall be a member of the General Assembly of the 4 Commonwealth of Pennsylvania. The third member shall be the 5 Secretary of Environmental Resources or his designee. The 6 appointed members [shall be appointed immediately after this act 7 become effective and] shall serve for terms of two years or 8 until their successors are appointed. The Secretary of 9 Environmental Resources OR HIS DESIGNEE shall serve for a like <-- 10 term THE SAME PERIOD AS HIS TENURE AS SECRETARY OF ENVIRONMENTAL <-- 11 RESOURCES. They shall serve without compensation, but shall be 12 paid their actual expenses incurred in and incident to the 13 performance of their duties as hereinafter set forth. The 14 Commonwealth shall contribute to the Interstate Commission on 15 the Potomac River Basin its pro rata share of the expenses of 16 said commission which shall be such sums as may be appropriated 17 for the purpose, but not less than the sum of one thousand two 18 hundred dollars ($1,200) per year for the biennium beginning 19 June first, one thousand nine hundred and forty-five. 20 * * * 21 Section 1.1. The Governor of the Commonwealth of 22 Pennsylvania shall appoint an alternate member for each of the 23 [three] two appointed members of the commission for the 24 Commonwealth of Pennsylvania created by section 1 of the act of 25 May 29, 1945 (P.L.1134). Each such alternate shall be appointed 26 from [the same body from which the member was appointed] among 27 the members of the General Assembly or the public, as the case 28 may be. THE SECRETARY OF ENVIRONMENTAL RESOURCES SHALL ALSO <-- 29 APPOINT AN ALTERNATE.
