                                     AN ACT

     1  Amending the act of May 29, 1945 (P.L.1134, No.405), entitled
     2     "An act to create a commission to act jointly with
     3     commissions appointed for like purpose by the States of West
     4     Virginia and Maryland, the Commonwealth of Virginia and the
     5     District of Columbia, which, together with three members to
     6     be appointed by the President of the United States, shall
     7     constitute the Interstate Commission on the Potomac River
     8     Basin, with power to cooperate in the abatement of the
     9     existing pollution, and in the control of future pollution of
    10     the waters of the drainage basin of the Potomac River within
    11     the States of Maryland and West Virginia, the Commonwealth of
    12     Virginia and the District of Columbia; to authorize the
    13     Governor of the State to execute on behalf of this State a
    14     compact with representatives of other states for the purpose
    15     of forming the above-mentioned commission; and creating a
    16     Potomac Valley Conservancy District; providing for the
    17     appointment of the Pennsylvania members of said commission
    18     for the Commonwealth of Pennsylvania, and their terms of
    19     office; and providing an appropriation," further providing
    20     for the members of the Interstate Commission on the Potomac
    21     River Basin for the Commonwealth.

    22     The General Assembly of the Commonwealth of Pennsylvania
    23  hereby enacts as follows:
    24     Section 1.  Sections 1 first paragraph and 1.1 of the act of
    25  May 29, 1945 (P.L.1134, No.405), entitled "An act to create a
    26  commission to act jointly with commissions appointed for like
    27  purpose by the States of West Virginia and Maryland, the


     1  Commonwealth of Virginia and the District of Columbia, which,
     2  together with three members to be appointed by the President of
     3  the United States, shall constitute the Interstate Commission on
     4  the Potomac River Basin, with power to cooperate in the
     5  abatement of the existing pollution, and in the control of
     6  future pollution of the waters of the drainage basin of the
     7  Potomac River within the States of Maryland and West Virginia,
     8  the Commonwealth of Virginia and the District of Columbia; to
     9  authorize the Governor of the State to execute on behalf of this
    10  State a compact with representatives of other states for the
    11  purpose of forming the above-mentioned commission; and creating
    12  a Potomac Valley Conservancy District; providing for the
    13  appointment of the Pennsylvania members of said commission for
    14  the Commonwealth of Pennsylvania, and their terms of office; and
    15  providing an appropriation," amended or added April 28, 1961
    16  (P.L.113, No.51), are amended to read:
    17     Section 1.  There is hereby created a commission consisting
    18  of three members, to act jointly with commissions appointed for
    19  like purposes by the States of West Virginia and Maryland, the
    20  Commonwealth of Virginia and the District of Columbia, and an
    21  additional three members to be appointed by the President of the
    22  United States and which, together with the other commissions
    23  appointed as hereinbefore mentioned, shall constitute and be
    24  known as the Interstate Commission on the Potomac River Basin.
    25  The said commission for the Commonwealth of Pennsylvania shall
    26  consist of three members [to]. Two members shall be named by the
    27  Governor[, one of whom]. One appointed member shall be [from the
    28  membership of the Pennsylvania Commission on Interstate
    29  Cooperation, and one of whom shall be a representative of the
    30  Sanitary Water Board, and one of whom] a member of the public

     1  knowledgeable in matters involving water pollution and the other
     2  member shall be a member of the General Assembly of the
     3  Commonwealth of Pennsylvania. The third member shall be the
     4  Secretary of Environmental Resources or his designee. The
     5  appointed members [shall be appointed immediately after this act
     6  become effective and] shall serve for terms of two years or
     7  until their successors are appointed. The Secretary of
     8  Environmental Resources shall serve for a like term. They shall
     9  serve without compensation, but shall be paid their actual
    10  expenses incurred in and incident to the performance of their
    11  duties as hereinafter set forth. The Commonwealth shall
    12  contribute to the Interstate Commission on the Potomac River
    13  Basin its pro rata share of the expenses of said commission
    14  which shall be such sums as may be appropriated for the purpose,
    15  but not less than the sum of one thousand two hundred dollars
    16  ($1,200) per year for the biennium beginning June first, one
    17  thousand nine hundred and forty-five.

    19     Section 1.1.  The Governor of the Commonwealth of
    20  Pennsylvania shall appoint an alternate member for each of the
    21  [three] two appointed members of the commission for the
    22  Commonwealth of Pennsylvania created by section 1 of the act of
    23  May 29, 1945 (P.L.1134). Each such alternate shall be appointed
    24  from [the same body from which the member was appointed] among
    25  the members of the General Assembly or the public, as the case
    26  may be. Each such alternate shall have the power to act in the
    27  absence of the person for whom he is an alternate. The term of
    28  each alternate shall run concurrently with the term of the
    29  member for whom he is an alternate.
    30     Section 2.  This act shall take effect in 60 days.
