AN ACT
1 Amending Title 75 (Vehicles) of the Pennsylvania Consolidated
2 Statutes, providing for the offense of dumping of vehicles in
3 cities of the first class.
4 The General Assembly of the Commonwealth of Pennsylvania
5 hereby enacts as follows:
6 Section 1. Title 75 of the Pennsylvania Consolidated
7 Statutes is amended by adding a section to read:
8 § 3712.1. Dumping of vehicles in cities of the first class.
9 (a) Offense defined.--It shall be unlawful for any person to
10 place any abandoned or nonrepairable vehicle on any highway or
11 public or private property with the intent of permanently
12 dumping such vehicle.
13 (b) Presumption of dumping.--If an abandoned or
14 nonrepairable vehicle is placed at any location at least five
15 blocks from the address of the last known owner of such vehicle,
16 a rebuttable presumption that the vehicle has been dumped shall
17 arise which may be rebutted only by clear and convincing
18 evidence.
1 (c) Penalties.--
2 (1) For a first offense, a person violating subsection
3 (a) commits a misdemeanor of the third degree and shall, upon
4 conviction, pay a fine of $1,000 plus all costs of disposing
5 of such vehicle under the provisions of Chapter 73 (relating
6 to abandoned vehicles and cargos).
7 (2) For a second or subsequent offense, a person
8 violating subsection (a) commits a misdemeanor of the second
9 degree and shall, upon conviction, pay a fine of $2,000 plus
10 all costs of disposing of such vehicle under the provisions
11 of Chapter 73.
12 Section 2. This act shall take effect in 60 days.
