AN ACT
Amending the act of June 23, 1931 (P.L.932, No.317), entitled
"An act relating to cities of the third class; and amending,
revising, and consolidating the law relating thereto," in
fire bureau, providing for emergency services reimbursement.
The General Assembly of the Commonwealth of Pennsylvania
hereby enacts as follows:
Section 1. The act of June 23, 1931 (P.L.932, No.317), known
as The Third Class City Code, reenacted and amended March 19,
2014 (P.L.52, No.22), is amended by adding a section to read:
Section 2110. Emergency Services Reimbursement.--(a) The
Commonwealth shall annually reimburse a city for emergency
services provided by the city at property owned or leased by the
Commonwealth within the city from the fund established under
subsection (b). The reimbursement may not be less than five
million dollars in any fiscal year and shall increase each year
according to the percentage increase in the Consumer Price Index
for All Urban Consumers for the Pennsylvania, New Jersey,
Delaware and Maryland area as officially reported by the United
States Department of Labor, Bureau of Labor Statistics.

(b) There is hereby established in the State Treasury a
special fund to be known as the Third Class City Emergency
Services Reimbursement Fund. Money in the fund is annually
appropriated to the city for the purposes authorized under this
section. The Commonwealth shall transfer one and four-tenths per
centum of the funds collected as the realty transfer tax under
Article XI-C of the act of March 4, 1971 (P.L.6, No.2), known as
the "Tax Reform Code of 1971," from the General Fund into the
fund.
(c) Definitions.--As used in this section, the following
words and phrases shall have the meanings given to them in this
subsection unless the context clearly indicates otherwise:
"City" shall mean a city of the third class where all of the
following apply:
(1) The city has a population of not less than forty
thousand and not more than fifty-five thousand residents based
on the most recent Federal decennial census.
(2) The city is located in a county of the third class.
(3) At least fifteen per centum of the property in the city
is owned or leased by the Commonwealth.
"Emergency services" shall mean services provided by a fire,
ambulance or rescue company.
"Fund" shall mean the Third Class City Emergency Services
Reimbursement Fund.
Section 2. This act shall take effect in 60 days.
