                                     AN ACT

     1  Amending Title 75 (Vehicles) of the Pennsylvania Consolidated
     2     Statutes, requiring protective headgear for pedalcycle
     3     riders; and providing a penalty.

     4     The General Assembly of the Commonwealth of Pennsylvania
     5  hereby enacts as follows:
     6     Section 1.  Title 75 of the Pennsylvania Consolidated
     7  Statutes is amended by adding a section to read:
     8  § 3510.  Protective headgear for pedalcycle riders.
     9     (a)  General rule.--
    10         (1)  No person who is six years of age or older shall
    11     operate a pedalcycle unless he is wearing protective headgear
    12     which complies with standards established by the department.
    13         (2)  No person operating a pedalcycle shall allow any
    14     person to ride as a passenger on a pedalcycle or in a
    15     pedalcycle trailer unless that passenger is wearing
    16     protective headgear which complies with standards established
    17     by the department.
    18     (b)  Proof of purchase.--The first violation of subsection

     1  (a) by any person may be dismissed by the court if the person
     2  charged produces proof that a helmet meeting the standards
     3  established by the department has been purchased for use by the
     4  operator or passenger.
     5     (c)  Exception.--This section shall not apply to the
     6  operation of a tricycle.
     7     (d)  Definitions.--As used in this section, the term "wearing
     8  protective headgear" means having a helmet of good fit fastened
     9  securely upon the head with the helmet straps.
    10     Section 2.  This act shall take effect in 60 days.
