AN ACT 1 Amending the act of May 17, 1921 (P.L.682, No.284), entitled "An 2 act relating to insurance; amending, revising, and 3 consolidating the law providing for the incorporation of 4 insurance companies, and the regulation, supervision, and 5 protection of home and foreign insurance companies, Lloyds 6 associations, reciprocal and inter-insurance exchanges, and 7 fire insurance rating bureaus, and the regulation and 8 supervision of insurance carried by such companies, 9 associations, and exchanges, including insurance carried by 10 the State Workmen's Insurance Fund; providing penalties; and 11 repealing existing laws," providing for coverage of alcohol 12 and drug abuse and dependency treatment resulting from court 13 action. 14 The General Assembly of the Commonwealth of Pennsylvania
1 hereby enacts as follows: 2 Section 1. The act of May 17, 1921 (P.L.682, No.284), known 3 as The Insurance Company Law of 1921, is amended by adding a 4 section to read: 5 Section 353.1. Coverage of Treatment.--No subscriber of a 6 health plan that is doing business in this Commonwealth shall be 7 deprived of alcohol and other drug abuse and addiction treatment 8 or coverage due to the identification of an alcohol and/or other 9 drug problem that occurs as a result of contact with the legal 10 or criminal justice system, or where treatment is required under 11 an order of a court of competent jurisdiction as long as the 12 treatment services are within the coverage of the health plan's 13 benefit package. 14 Section 2.
