A SUPPLEMENT 1 To the act of July 28, 1966 (3rd Sp.Sess., P.L.87, No.3), 2 entitled "An act providing for the establishment and 3 operation of the University of Pittsburgh as an 4 instrumentality of the Commonwealth to serve as a State- 5 related university in the higher education system of the 6 Commonwealth; providing for change of name; providing for the 7 composition of the board of trustees; terms of trustees, and 8 the power and duties of such trustees; authorizing 9 appropriations in amounts to be fixed annually by the General 10 Assembly; providing for the auditing of accounts of 11 expenditures from said appropriations; providing for public 12 support and capital improvements; authorizing the issuance of 13 bonds exempt from taxation within the Commonwealth; requiring 14 the chancellor to make an annual report of the operations of 15 the University of Pittsburgh," making appropriations for 16 carrying the same into effect; providing for a basis for 17 payments of such appropriations; and providing a method of 18 accounting for the funds appropriated. 19 The General Assembly of the Commonwealth of Pennsylvania 20 hereby enacts as follows: 21 Section 1. (a) The following sums, or as much thereof as 22 may be necessary, are hereby appropriated to the Trustees of the 23 University of Pittsburgh for the fiscal year July 1, 1992, to 24 June 30, 1993, for the purposes and in the amounts as shown: 25 (1) For educational and general expenses...... $118,349,000
1 (2) For instruction - Doctor of Medicine only. 6,239,000 2 (3) For operation of dental clinics in the 3 school of dentistry............................... 1,030,000 4 (4) To enhance the recruitment and retention 5 of disadvantaged students. This appropriation is 6 contingent on the university submitting to the 7 General Assembly by October 1, 1992, a report 8 evaluating the university's effort to recruit and 9 retain minority students and teachers............. 300,000 10 (5) For general maintenance and operation of 11 the Western Psychiatric Institute and Clinic...... 7,693,000 12 (6) For the teen suicide center at the Western 13 Psychiatric Institute and Clinic.................. 497,000 14 (b) The appropriations provided in subsection (a) shall be 15 contingent upon the university complying with all provisions of 16 the act of June 21, 1957 (P.L.390, No.212), referred to as the 17 Right-to-Know Law, as they are applied to agencies covered by 18 that law. 19 (c) No funds from an appropriation made by this act shall be 20 made available for expenditure after October 1, 1992, unless a 21 good faith effort, as prescribed by the Department of Public 22 Welfare, has been made to hire welfare clients for new jobs 23 created as a result of the State appropriations. No existing 24 employees or employees on unemployment compensation are to be 25 displaced by this effort. A report detailing these efforts is to 26 be submitted to the Department of Public Welfare by September 27 15, 1992. The Department of Public Welfare shall give written 28 notification of compliance to the State Treasurer. 29 Section 2. Payments to the University of Pittsburgh on 30 account of the appropriations for all items as provided in 19920H2669B3516 - 2 -
1 section 1 shall be made on the basis of costs during the fiscal 2 year. 3 Section 3. If necessary, the University of Pittsburgh may 4 transfer funds between the appropriations listed in section 1(1) 5 and (2): Provided, That the aggregate amount transferred into or 6 out of each appropriation during the fiscal year shall not 7 exceed 5% of the amount specifically appropriated for that 8 purpose. 9 Section 4. (a) Payments to the University of Pittsburgh of 10 the appropriations provided in section 1 shall be made monthly 11 during the fiscal year. 12 (b) Such monthly payments shall be made in accordance with 13 the provisions of section 2 on the basis of estimated costs. The 14 estimate of costs shall be submitted by the University of 15 Pittsburgh to the Secretary of Education, the General Assembly 16 and the State Treasurer not later than 30 days prior to the date 17 on which such payment is to be made. 18 Section 5. (a) The University of Pittsburgh shall apply the 19 moneys appropriated by this act only for such purposes as are 20 permitted in this act and shall at all times maintain proper 21 records showing the application of such moneys. Not later than 22 120 days after the close of the fiscal year to which this act 23 relates, the University of Pittsburgh shall file, with the 24 Secretary of Education, the General Assembly, the Auditor 25 General of the Commonwealth and the chief administrator of each 26 branch campus, a statement setting forth the amounts and 27 purposes of all expenditures made from moneys appropriated by 28 this act and other university accounts during said fiscal year, 29 as provided in section 2, used as a basis for receipt of any 30 appropriation during said fiscal year. 19920H2669B3516 - 3 -
1 (b) Such statement of expenditures and costs shall be 2 reviewed by the Auditor General of the Commonwealth, and he 3 shall have the right, in respect to the moneys appropriated by 4 this act, to audit and disallow expenditures made for purposes 5 not permitted by this act and to cause such sums to be recovered 6 and paid by the University of Pittsburgh to the State Treasurer. 7 In respect to expenditures made by the university from moneys 8 other than those appropriated by this act, the Auditor General 9 shall have the right to review only, and he shall file annually 10 with the General Assembly such information concerning such 11 expenditures as the General Assembly or any of its committees 12 may require. 13 Section 6. A report shall be submitted to the Governor and 14 the Appropriations and Education Committees of the Senate and 15 House of Representatives and shall include data for all 16 programs, except for the Doctor of Medicine program. The report, 17 to be submitted prior to September 1, 1993, shall cover the 12- 18 month period beginning with the summer term 1992 and shall 19 include: 20 (1) The following counts and distributions for each term 21 during the period: 22 (i) The definitions and numbers of faculty members employed 23 full time, of faculty members employed part time, of full-time 24 students enrolled in graduate courses, of full-time students 25 enrolled in undergraduate courses, of part-time students 26 enrolled in graduate courses and of part-time students enrolled 27 in undergraduate courses. 28 (ii) The total numbers of undergraduate student credit 29 hours, divided into lower division and upper division course 30 levels, and of graduate student credit hours, divided into three 19920H2669B3516 - 4 -
1 course levels--master's, first professional and doctoral. 2 (iii) The number of different courses scheduled by level of 3 instruction and the number of sections of individual instruction 4 scheduled by level of instruction, each further subdivided by 5 two-digit Classification of Instructional Program (CIP) 6 categories of instructional programs of higher education as 7 defined by the National Center for Education Statistics, United 8 States Department of Education. 9 (iv) The number of terms scheduled and the dates thereof. 10 (2) For the summer term and the following academic year in 11 total and for each two-digit CIP program category, a 12 classification of faculty members or other professional 13 employees by title, including: professor, associate professor, 14 assistant professor, instructor, lecturer, research associate, 15 librarian and academic administrator; faculty members or other 16 professional employees under each title to be subdivided by type 17 of assignment: teaching and nonteaching; and each such set of 18 faculty members or other professional employees to be further 19 subdivided by type of employment: full-time or part-time; and 20 the following aggregates for each such subdivided 21 classification: 22 (i) The number of faculty and other professional employees 23 and their full-time equivalence in instructional and 24 noninstructional functions. 25 (ii) The sum of credits assigned to undergraduate classroom 26 courses and the sum of credits assigned to graduate classroom 27 courses taught, divided into lower division, upper division, 28 master's, first professional and doctoral course levels. 29 (iii) The sum of credits assigned to undergraduate 30 individual instruction courses and the sum of credits assigned 19920H2669B3516 - 5 -
1 to graduate individual instruction courses taught, divided into 2 lower division, upper division, master's, first professional and 3 doctoral course levels. 4 (iv) The sum of undergraduate classroom student credit hours 5 and the sum of graduate classroom student credit hours 6 generated, divided into lower division, upper division, 7 master's, first professional and doctoral course levels. 8 (v) The sum of undergraduate individual instruction student 9 credit hours and the sum of graduate individual instruction 10 student credit hours generated, divided into lower division, 11 upper division, master's, first professional and doctoral course 12 levels. 13 (vi) The total salary paid for instructional functions and 14 for noninstructional functions and the amount of this salary 15 paid for each of these functions from university funds, Federal 16 funds and other funds. 17 (3) For each term of the period covered for each faculty 18 member employed full time identified by two-digit CIP program 19 category and title, the report shall contain an analysis of the 20 average hours per week spent in university-related activities, 21 stating specifically hours spent in undergraduate classroom 22 contact and graduate classroom contact, hours spent in 23 preparation, hours spent in research and hours spent in public 24 service. 25 Section 7. In addition to the requirements in section 6 26 relative to this appropriation, the report covering the 12-month 27 period beginning with the summer term 1992 shall include for all 28 programs of the university: 29 (1) Minimum number of credits required for a baccalaureate 30 degree and for a master's degree. 19920H2669B3516 - 6 -
1 (2) Number of bachelor's degrees, master's degrees, first 2 professional degrees and doctoral degrees awarded in 1990, 1991, 3 1992 and estimated 1993. 4 Section 8. The University of Pittsburgh shall provide full, 5 complete and accurate information as may be required by the 6 Department of Education or the Majority Chairman or the Minority 7 Chairman of the Appropriations Committee of the Senate or the 8 Majority Chairman or the Minority Chairman of the Appropriations 9 Committee of the House of Representatives. 10 Section 9. The University of Pittsburgh shall report its 11 revenues and expenditures and present its financial statements 12 required under the provisions of this act in accordance with 13 generally accepted accounting principles and procedures for 14 educational institutions as set forth in the "Higher Education 15 Finance Manual, United States Department of Health, Education 16 and Welfare (1975)" and the "Commonwealth of Pennsylvania Budget 17 Instructions for the State System of Higher Education, State- 18 Related Universities and Non-State-Related Colleges and 19 Universities." 20 Section 10.
