AN ACT 1 Amending the act of August 14, 1991 (P.L.342, No.36), entitled 2 "An act providing for the preservation of the State Lottery 3 Fund; further providing for pharmaceutical assistance for the 4 elderly; further providing for transportation assistance to 5 the elderly; providing for pharmaceutical purchasing; 6 conferring powers and duties upon the Department of Aging, 7 the Department of Revenue and the Department of 8 Transportation; imposing penalties; and making repeals," 9 further defining "income" for purposes of pharmaceutical 10 assistance for the elderly. 11 The General Assembly of the Commonwealth of Pennsylvania 12 hereby enacts as follows: 13 Section 1. The definition of "income" in section 302 of the 14 act of August 14, 1991 (P.L.342, No.36), known as the Lottery 15 Fund Preservation Act, is amended to read: 16 Section 302. Definitions. 17 The following words and phrases when used in this chapter 18 shall have the meanings given to them in this section unless the 19 context clearly indicates otherwise: 20 * * *
1 "Income." All income from whatever source derived, 2 including, but not limited to, salaries, wages, bonuses, 3 commissions, income from self-employment, alimony, support 4 money, cash public assistance and relief, the gross amount of 5 any pensions or annuities, including railroad retirement 6 benefits, all benefits received under the Federal Social 7 Security Act (except Medicare benefits), all benefits received 8 under State unemployment insurance laws and veterans' disability 9 payments, all interest received from the Federal Government or 10 any state government, or any instrumentality or political 11 subdivision thereof, realized capital gains, rentals, excluding 12 expenses which are ordinarily incurred in and necessary for the 13 production of or collection of rents or the management, 14 conservation or maintenance of rents, workmen's compensation and 15 the gross amount of loss of time insurance benefits, life 16 insurance benefits and proceeds, except the first $5,000 of the 17 total of death benefits payments, and gifts of cash or property, 18 other than transfers by gift between members of a household, in 19 excess of a total value of $300, but shall not include surplus 20 food or other relief in kind supplied by a government agency or 21 property tax rebate. 22 * * * 23 Section 2.
