AN ACT

Amending the act of July 28, 1953 (P.L.723, No.230), entitled,

2

as amended, "An act relating to counties of the second class

3

and second class A; amending, revising, consolidating and

4

changing the laws relating thereto," further providing for

5

compensation of elected officers.

The General Assembly of the Commonwealth of Pennsylvania

7

hereby enacts as follows:

Section 1.  Section 401.1 of the act of July 28, 1953

9

(P.L.723, No.230), known as the Second Class County Code, added

10

Oct. 31, 1985 (P.L.299, No.71) is amended to read:

11

Section 401.1.  Compensation of Elected Officers.--(a)  The

12

minimum annual salaries of the elected officers of counties of

13

the second class set forth in section 401 shall be as follows:

14

(1)  County commissioner, chairman, $41,540;

15

(2)  County commissioners, other than chairman, $39,295;

16

(3)  Controller, $36,181;

17

(4)  Treasurer, $36,181;

18

(5)  Coroner, $30,000;

19

(6)  Recorder of Deeds, $33,681;

(7)  Prothonotary, $33,681;

(8)  Clerk of Courts, $33,681;

3

(9)  Register of Wills, $34,804;

4

(10)  Sheriff, $30,000; and

5

(11)  Jury Commissioner, $25,700.

(a.1)  The sheriff and supervisors appointed by the sheriff

7

who are not members of bargaining units shall receive not less

8

than the same dollar increase including fringe benefits but

9

excluding overtime and festive holiday pay as received by the

10

highest-ranking member participating in the bargaining unit.

(b)  From and after the effective date of this section, the

12

county commissioners of counties of the second class shall have

13

the power to fix the salary of all county officers governed by

14

the provisions of subsection (a).

15

(c)  The county commissioners of counties of the second class

16

shall not reduce the salary of any county officer below the

17

amount set forth in subsection (a).

18

(d)  As used in this section, the term "bargaining unit"

19

means employes of the sheriff who through labor organizations or

20

other representatives designated by fifty per centum or more of

21

the employes have the right to bargain collectively with their

22

public employers concerning the terms and conditions of their

23

employment, including compensation, hours, working conditions,

24

retirement, pensions and other benefits and the right to an

25

adjustment or settlement of their grievances or disputes.

26

Section 2.  This act shall take effect in 60 days.
