AN ACT

 

1Authorizing the Treasury Department to process Supplemental
2Security Income State Supplement Payments for other states;
3providing for duties of the Treasury Department; and
4establishing the SSP Processing Account.

5The General Assembly of the Commonwealth of Pennsylvania
6hereby enacts as follows:

7Section 1. Short title.

8This act shall be known and may be cited as the Supplemental
9Security Income State Supplement Payments for Out-of-State
10Payors Act.

11Section 2. Definitions.

12The following words and phrases when used in this act shall
13have the meanings given to them in this section unless the
14context clearly indicates otherwise:

15"Account." The SSP Processing Account established in section
164.

17"Department." The Treasury Department of the Commonwealth.

1Section 3. Processing of payments.

2(a) General rule.--The department may process Supplemental
3Security Income State Supplement Payments for out-of-State
4payors.

5(b) Contracts.--The department may enter into contracts, on
6a contingent fee or other basis, associated with or arising out
7of the activities of the department under subsection (a).

8Section 4. Account.

9(a) Establishment.--There is established a restricted
10account in the General Fund to be known as the SSP Processing
11Account. The department shall credit to the account all funds
12collected or received from processing Supplemental Security
13Income State Supplement Payments for out-of-State payors. On
14July 31 of each year, all funds in the account which have not
15been appropriated by the General Assembly in accordance with
16subsection (b) shall be transferred to the General Fund.

17(b) Use.--The General Assembly shall <-annually appropriate
18funds from the account to support the department's activities
19under this act. The department shall submit a request for the 
20appropriation of the funds under Article VI of the act of April 
219, 1929 (P.L.177, No.175), known as The Administrative Code of 
221929. <-Each annual appropriation from the account shall lapse, in 
23accordance with section 621 of the act of April 9, 1929 
24(P.L.177, No.175), known as The Administrative Code of 1929, to 
25the General Fund.

26Section 5. Reporting.

27The department shall, by March 31 of each year, issue a
28report to the Governor, the majority chair and the minority
29chair of the Appropriations Committee of the Senate and the
30majority chair and minority chair of the Appropriations

1Committee of the House of Representatives. The report shall
2contain at least the following information <-for the reporting 
3period:

<-4(1) A report of all of the department's activities
5undertaken in accordance with this act.

6(2) A list of the contracts authorized under section
73(b).

8(1) (3) A detailed <-breakdown <-accounting of the
9department's operating costs and other costs incurred for
10activities authorized under this act for the 12 months prior
11to the date of the report.

<-12(2) <-(4) The total revenue collected by the department
13for activities authorized under this act during the period
14covered by the report.

<-15(3) <-(5) A detailed estimate of the department's
16operating costs and other costs for activities authorized
17under this act for the next fiscal year that commences after
18the date of the report, including the projected cost of a
19contract authorized under section 3(b).

20Section 6. Limitations.

21The following shall apply to an activity authorized under
22this act:

23(1) Nothing under this act, including, but not limited
24to, a contract authorized under this act and the processing
25of a Supplemental Security Income State Supplement Payment
26for out-of-State payors, shall be construed to permit or
27authorize the waiver of sovereign immunity for the purposes
28of 1 Pa.C.S. § 2310 (relating to sovereign immunity
29reaffirmed; specific waiver).

30(2) Nothing under this act shall permit the department

1or the Commonwealth to indemnify another party for a loss,
2damage or shortfall associated with a contract to process
3Supplemental Security Income State Supplement Payments for
4out-of-State payors.

5Section 31. Appropriation.

6For fiscal year 2014-2015, $4,500,000 is appropriated on a
7continuing basis from the account to the department to support
8the department's activities under this act.

9Section 32. Effective date.

10This act shall take effect immediately.
