                                     AN ACT

     1  Amending the act of July 17, 1961 (P.L.659, No.339), entitled
     2     "An act relating to bituminous coal mines; amending,
     3     revising, consolidating and changing the laws relating
     4     thereto; providing for the health and safety of persons
     5     employed in and about the bituminous coal mines of
     6     Pennsylvania and for the protection and preservation of
     7     property connected therewith; prescribing powers and duties
     8     in connection therewith; prescribing penalties; and repealing
     9     existing laws," changing provisions relating to
    10     qualifications for certification as mine foremen, mine
    11     electricians, assistant mine foremen and mine examiners.

    12     The General Assembly of the Commonwealth of Pennsylvania
    13  hereby enacts as follows:
    14     Section 1.  Subsections (a), (a.1) and (a.2) of section 206,
    15  act of July 17, 1961 (P.L.659, No.339), known as the
    16  "Pennsylvania Bituminous Coal Mine Act," amended December 13,
    17  1974 (P.L.943, No.311), are amended to read:
    18     Section 206.  Qualifications for Certification.--(a)
    19  Applicants for certificates of qualification as mine foremen and
    20  mine electricians, shall be citizens of the United States, of
    21  good moral character, and of known temperate habits, at least
    22  twenty-three years of age, and shall have had at least five


     1  years practical experience after eighteen years of age, as
     2  miners or mining engineers or men of general work with at least
     3  three years' experience in working sections (a working section
     4  for the purposes of this act shall be deemed to be the area from
     5  the working face extending back one thousand feet) in
     6  underground bituminous coal mines in the United States:
     7  Provided, That graduates with a bachelors degree in civil
     8  engineering, electrical engineering or mining engineering, or an
     9  associate degree in the mining engineering course of a
    10  recognized institution of learning may, after examination, be
    11  granted certificates of qualification by an examining board as
    12  mine foremen, and mine electricians if possessed of an aggregate
    13  of not less than three years practical experience as miners or
    14  men of general work or mining engineers, in underground
    15  bituminous coal mines in the United States in the working
    16  section.
    17     (a.1)  Applicants for certificates of qualification as
    18  assistant mine foremen shall be citizens of the United States,
    19  of good moral character and of known temperate habits, and shall
    20  have had at least four years' practical experience, with at
    21  least three years' experience in working sections, after
    22  eighteen years of age, as miners or mining engineers or men of
    23  general work, in underground bituminous coal mines in the United
    24  States: Provided, That graduates with a bachelors degree in
    25  civil engineering, electrical engineering or mining engineering,
    26  or an associate degree in the mining engineering course of a
    27  recognized institution of learning may, after examination, be
    28  granted certificates of qualification by an examining board as
    29  assistant mine foremen, if possessed of an aggregate of not less
    30  than three years practical experience as miners or mining

     1  engineers or men of general work, in underground bituminous coal
     2  mines in the United States in working sections.
     3     (a.2)  Applicants for certificates of qualification as mine
     4  examiners shall be citizens of the United States, of good moral
     5  character and of known temperate habits, and shall have had at
     6  least three years' practical experience after eighteen years of
     7  age, as miners or mining engineers or men of general work, in
     8  underground bituminous coal mines in the United States in
     9  working sections.
