                                     AN ACT

     1  Authorizing and directing the Department of General Services,
     2     with the approval of the Department of Corrections and the
     3     Governor, to grant and convey to the Township of Cresson land
     4     situate in the Township of Cresson, Cambria County,
     5     Pennsylvania.

     6     The General Assembly of the Commonwealth of Pennsylvania
     7  hereby enacts as follows:
     8     Section 1.  The Department of General Services, with the
     9  approval of the Department of Corrections and the Governor, is
    10  hereby authorized and directed on behalf of the Commonwealth of
    11  Pennsylvania to grant and convey to the Township of Cresson, for
    12  a consideration of one dollar, the following tracts of land
    13  lying in the Township of Cresson, Cambria County, Pennsylvania,
    14  bounded and described as follows:
    15                              PARCEL 1
    16     Beginning at an iron pin on the southerly right-of-way line
    17  of L.R. 53 and on the northeast corner of lands now or formerly
    18  of Larry & Joyce Wade; thence along the southerly right-of-way
    19  line of said L.R. 53 south 61 degrees 28 minutes 30 seconds east


     1  135.63 feet to an iron pin set on the westerly right-of-way line
     2  of L.R. 1101; thence along the westerly right-of-way line of
     3  said L.R. 1101 the following three courses and distances: south
     4  24 degrees 51 minutes 08 seconds west 140.89 feet to an iron pin
     5  set; thence south 09 degrees 24 minutes 11 seconds west 185.27
     6  feet to an iron pin set; thence south 18 degrees 14 minutes 54
     7  seconds west 140.64 feet to an iron pin set on the northerly
     8  line of an unopened 33 foot street; thence along the northerly
     9  line of said unopened 33 foot street north 81 degrees 14 minutes
    10  51 seconds west 187.43 feet to an iron pin set on the easterly
    11  line of Pine Ridge Road; thence along the easterly line of said
    12  Pine Ridge Road north 08 degrees 45 minutes 09 seconds east
    13  221.33 feet to an iron pin set; thence south 75 degrees 01
    14  minute 43 seconds east 3.52 feet to an iron pin set; thence
    15  north 08 degrees 17 minutes 06 seconds east 22 feet to an iron
    16  pin set on the southerly right-of-way line of Service Road "B";
    17  thence along the southerly right-of-way line of said Service
    18  Road "B" south 79 degrees 57 minutes 08 seconds east 120.74 feet
    19  to an iron pin set on the easterly end of said Service Road "B";
    20  thence along the easterly end of said Service Road "B" and
    21  continuing along the easterly line of lands now or formerly of
    22  Larry & Joyce Wade north 08 degrees 47 minutes east 265 feet to
    23  an iron pin the place of beginning.
    24     Containing 1.701 acres all as is more fully shown on a map
    25  prepared by L. Robert Kimball & Associates and dated March 1,
    26  1990.
    27     Being part of the same premises the title to which became
    28  vested in The Commonwealth of Pennsylvania by deed from Andrew
    29  Carnegie, et ux., dated February 12, 1910 and recorded in the
    30  office for the recording of deeds, etc., in and for Cambria

     1  County in Deed Book Vol. 223, page 620.
     2                              PARCEL 2
     3     Beginning at a point on the westerly right-of-way line of new
     4  State highway Route 22 and on the southeast corner of lands now
     5  or formerly of John D. Gailey, et ux.; thence along the westerly
     6  right-of-way line of said new State highway Route 22 the
     7  following seven courses and distances: south 18 degrees 15
     8  minutes west 99 feet to a point; thence south 43 degrees 15
     9  minutes west 196 feet to a point; thence south 33 degrees 15
    10  minutes west 199 feet to a point; thence south 28 degrees west
    11  101 feet to a point; thence south 61 degrees 15 minutes west 157
    12  feet to a point; thence south 45 degrees 45 minutes west 233
    13  feet to a point; thence south 37 degrees west 77 feet to a point
    14  on the northeast corner of lands now or formerly of Evan L.
    15  Jones; thence along the northerly line of said Jones' lands
    16  north 70 degrees 49 minutes west a scaled "unsurveyed" distance
    17  of 1,050 feet, more or less, to a point on the southwest corner
    18  of lands now or formerly of Cresson Township Supervisors; thence
    19  along the southerly line of said lands now or formerly of
    20  Cresson Township Supervisors, and continuing along the southerly
    21  line of said lands now or formerly of John D. Gailey, et ux.;
    22  north 74 degrees 41 minutes east 1,729.75 feet to a point the
    23  place of beginning.
    24     Containing 12.5 acres, all as is more fully shown on a
    25  preliminary property plat prepared by L. Robert Kimball &
    26  Associates and dated May 1990.
    27     Being part of the same premises the title to which became
    28  vested in The Commonwealth of Pennsylvania by deed from Andrew
    29  Carnegie, et ux., dated February 12, 1910 and recorded in the
    30  office for the recording of deeds, etc., in and for Cambria

     1  County in Deed Book Vol. 223, page 620.
     2     Section 2.  The conveyance shall be made under and subject to
     3  all easements, servitudes and rights of others, including, but
     4  not confined to, streets, roadways and rights of any telephone,
     5  telegraph, water, electric, sewer, gas or pipeline companies, as
     6  well as under and subject to any interest, estates or tenancies
     7  vested in third persons, whether or not appearing of record, for
     8  any portion of the land or improvements erected thereon.
     9     Section 3.  The deed of conveyance shall be approved as
    10  provided by law and shall be executed by the Secretary of
    11  General Services in the name of the Commonwealth of
    12  Pennsylvania.
    13     Section 4.  Costs and fees incidental to this conveyance
    14  shall be borne by the grantee.
    15     Section 5.  This act shall take effect immediately.
