                                     AN ACT

     1  Amending the act of April 14, 1972 (P.L.233, No.64), entitled
     2     "An act relating to the manufacture, sale and possession of
     3     controlled substances, other drugs, devices and cosmetics;
     4     conferring powers on the courts and the secretary and
     5     Department of Health, and a newly created Pennsylvania Drug,
     6     Device and Cosmetic Board; establishing schedules of
     7     controlled substances; providing penalties; requiring
     8     registration of persons engaged in the drug trade and for the
     9     revocation or suspension of certain licenses and
    10     registrations; and repealing an act," regulating the sale of
    11     diet pills.

    12     The General Assembly of the Commonwealth of Pennsylvania
    13  hereby enacts as follows:
    14     Section 1.  Section 35 of the act of April 14, 1972 (P.L.233,
    15  No.64), known as The Controlled Substance, Drug, Device and
    16  Cosmetic Act, is amended to read:
    17     Section 35.  Promulgation of Regulations.--(a)  The secretary
    18  shall have the authority to promulgate in accordance with the
    19  provisions of this section and of the act of July 31, 1968
    20  (P.L.769, No. 240), known as the "Commonwealth Documents Law"


     1  any regulations hereinbefore referred to in this act and such
     2  other regulations with the consent of the board regarding the
     3  possession, distribution, sale, purchase or manufacture of
     4  controlled substances, other drugs or devices or cosmetics as
     5  may be necessary to aid in the enforcement of this act.
     6     (b)  The secretary shall promulgate regulations to require
     7  that the sale of diet pills not by prescription be sold behind
     8  the counter and shall not be sold to persons under eighteen
     9  years of age.
    10     Section 2.  This act shall take effect in 60 days.
