                                  A SUPPLEMENT

     1  To the act of July 7, 1972 (P.L.743, No.176), entitled "An act
     2     providing for the establishment and operation of Lincoln
     3     University as an instrumentality of the Commonwealth to serve
     4     as a State-related institution in the higher education system
     5     of the Commonwealth; providing for change of name; providing
     6     for the composition of the board of trustees; terms of
     7     trustees, and the power and duties of such trustees;
     8     providing for preference to Pennsylvania residents in
     9     tuition; authorizing appropriations in amounts to be fixed
    10     annually by the General Assembly; providing for the auditing
    11     of accounts of expenditures from said appropriations;
    12     providing for public support and capital improvements;
    13     authorizing the issuance of bonds exempt from taxation within
    14     the Commonwealth; requiring the President to make an annual
    15     report of the operations of Lincoln University," making
    16     appropriations for carrying the same into effect, providing
    17     for a basis for payments of such appropriation, and providing
    18     a method of accounting for the funds appropriated.

    19     The General Assembly of the Commonwealth of Pennsylvania
    20  hereby enacts as follows:
    21     Section 1.  The following sums, or as much thereof as may be
    22  necessary, is hereby specifically appropriated to the Trustees
    23  of the College of Lincoln University, Chester County, for the
    24  fiscal period July 1, 1980 to June 30, 1981, for the purposes
    25  and in the amounts as shown:


     1     (1)  For educational and general expenses.....    $3,602,000
     2     (2)  For cost of student aid..................       150,000
     3     (3)  For the masters program, Eagleville
     4  Campus...........................................       250,000
     5     Section 2.  Payments to Lincoln University on account of the
     6  appropriations for the items provided in section 1 shall be made
     7  on the basis of costs during the fiscal period.
     8     Section 3.  Payments to Lincoln University of the
     9  appropriation herein provided shall be made monthly during the
    10  fiscal period.
    11     Such monthly payments shall be made in accordance with the
    12  provisions of section 2, on the basis of estimated costs. The
    13  estimate of costs shall be submitted by Lincoln University to
    14  the Secretary of Education, the General Assembly and to the
    15  State Treasurer not later than 30 days prior to the date on
    16  which such payment is to be made.
    17     Section 4.  Lincoln University shall apply the moneys
    18  appropriated by this act only for such purposes as are permitted
    19  in this act and shall at all times maintain proper records
    20  showing the application of such moneys. Not later than 120 days
    21  after the close of the fiscal period to which this act relates,
    22  Lincoln University shall file with the Secretary of Education,
    23  the General Assembly and with the Auditor General of the
    24  Commonwealth a statement setting forth the amounts and purposes
    25  of all expenditures made from moneys appropriated by this act
    26  and costs, as provided in section 2, used as a basis for receipt
    27  of any appropriation during said fiscal period. Such statement
    28  of expenditures and costs shall be reviewed by the Auditor
    29  General of the Commonwealth, and he shall have the right, in
    30  respect to the moneys appropriated by this act, to audit and

     1  disallow expenditures made for purposes not permitted by this
     2  act. The Auditor General shall also make a determination of
     3  costs and make certification as to their correctness. In respect
     4  to expenditures made by the university from moneys other than
     5  those appropriated by this act, the Auditor General shall have
     6  the right to review only and he shall file annually with the
     7  General Assembly such information concerning said expenditures
     8  as the General Assembly or any of its committees may require.
     9     Section 5.  A report shall be submitted to the Governor and
    10  the Appropriations and Education Committees of the Senate and
    11  House of Representatives and shall include data for all programs
    12  except the Doctor of Medicine program. Each such report, to be
    13  submitted prior to October 1, 1981, shall cover the 12-month
    14  period beginning September 1, 1980 and shall include for each
    15  term during the period:
    16     (1)  The following counts and distributions:
    17     (i)  The definitions and numbers of faculty members, employed
    18  full-time, of faculty members employed part-time, of full-time
    19  students enrolled in graduate courses, of full-time students
    20  enrolled in undergraduate courses, of part-time students
    21  enrolled in graduate courses, and of part-time students enrolled
    22  in undergraduate courses.
    23     (ii)  A distribution of faculty members employed part-time by
    24  the percentage of full-time employment.
    25     (iii)  Total numbers of undergraduate student credit hours,
    26  divided into lower division and upper division course levels,
    27  and of graduate student credit hours divided into three course
    28  levels--master's, first professional and doctoral.
    29     (iv)  Number of different courses scheduled by level of
    30  instruction and the number of students receiving individual

     1  instruction at each level of instruction.
     2     (v)  Number of terms scheduled and the dates thereof.
     3     (2)  Two classifications: one, a classification of faculty
     4  members or other professional employees by title including:
     5  professor, associate professor, assistant professor, instructor,
     6  lecturer, research associate, librarian, and academic
     7  administrator; faculty members or other professional employees
     8  under each title to be subdivided by type of assignment:
     9  instructional or noninstructional divided into teaching and
    10  nonteaching, and each such set of faculty members or other
    11  professional employees to be further subdivided by type of
    12  employment: full-time or part-time; and two, a classification of
    13  faculty members and other professional employees by school and
    14  department to be subdivided by type of assignment: instructional
    15  or noninstructional divided into teaching and nonteaching, and
    16  each such set of faculty members or other professional employees
    17  to be further subdivided by type of employment: full-time or
    18  part-time; and the following aggregates for each subdivision in
    19  each classification:
    20     (i)  The number.
    21     (ii)  The sum of credits assigned to undergraduate classroom
    22  courses and the sum of credits assigned to graduate classroom
    23  courses taught, divided into lower division, upper division,
    24  master's, first professional and doctoral course levels.
    25     (iii)  The sum of undergraduate classroom student credit
    26  hours and the sum of graduate classroom student credit hours
    27  generated; divided into lower division, upper division,
    28  master's, first professional and doctoral course levels.
    29     (iv)  The sum of undergraduate individual instruction student
    30  credit hours and the sum of graduate individual instruction

     1  student credit hours generated; divided into lower division,
     2  upper division, master's, first professional and doctoral course
     3  levels.
     4     (v)  Total salary paid.
     5     (vi)  Total salary paid from college or university funds.
     6     (vii)  Total salary paid from Federal funds.
     7     (viii)  Total salary paid from other funds.
     8     (3)  For each term of the period covered for each faculty
     9  member employed full-time identified by school, department and
    10  title:
    11     An analysis of the average hours per week spent in college or
    12  university-related activities, stating specifically hours spent
    13  in undergraduate classroom contact and graduate classroom
    14  contact, hours spent in preparation, hours spent in research and
    15  hours spent in public service.
    16     Section 6.  In addition to the above requirements relative to
    17  this appropriation, each report covering the 12-month period
    18  beginning September 1, 1980, shall include for all programs of
    19  the university:
    20     (1)  Minimum number of credits required for a baccalaureate
    21  degree and for a master's degree.
    22     (2)  Number of bachelor's degrees, master's degrees, first
    23  professional degrees, and doctoral degrees awarded in 1978,
    24  1979, 1980 and estimated 1981.
    25     The university shall report its revenues and expenditures and
    26  present its financial statements required under the provisions
    27  of this act in accordance with "Higher Education Finance Manual"
    28  (1975).
    29     Section 7.  All increases in this appropriation in excess of
    30  a 5% increase over the previous nonpreferred appropriation for

     1  this institution shall be used for maintaining current student
     2  tuition costs, and only be utilized on funding current existing
     3  academic programs or direct student educational related costs.
     4  These moneys may not be used to fund any increase in
     5  administrative personnel, new programs, or nonacademic
     6  expenditures. The administration and governing body of the
     7  institution shall produce the financial accounting of these
     8  expenditures to the General Assembly by June 30, 1981 for the
     9  first nine months of the fiscal year July 1, 1980 to June 30,
    10  1981.
    11     Section 8.  The university shall provide such information and
    12  in such form and manner as the Department of Education may
    13  prescribe.
    14     Section 9.  The university shall report its revenues and
    15  expenditures and present its financial statements required under
    16  the provisions of this act in accordance with generally accepted
    17  accounting principles and procedures for educational
    18  institutions as set forth in "Higher Education Finance Manual"
    19  United States Department of Health, Education and Welfare (1975)
    20  with the exceptions set forth in the Commonwealth of
    21  Pennsylvania Budget Instructions for State-Related Universities,
    22  Phase I, Fiscal Year 1980-1981. Credits granted for non-
    23  traditional programs such as CLEP, lifelong learning etc.,
    24  including all related costs and revenues thereof shall be
    25  excluded from the function of "Instruction" and included under
    26  "Public Service."
    27     Section 10.  This act shall take effect July 1, 1980.
