AN ACT 1 Amending Title 30 (Fish) of the Pennsylvania Consolidated 2 Statutes, providing for the imposition of pollution abatement 3 surcharges on licenses and permits. 4 The General Assembly of the Commonwealth of Pennsylvania 5 hereby enacts as follows: 6 Section 1. Chapter 5 of Title 30 of the Pennsylvania 7 Consolidated Statutes is amended by adding a subchapter to read: 8 CHAPTER 5 9 FISCAL AFFAIRS 10 * * * 11 SUBCHAPTER D 12 SURCHARGES 13 Sec. 14 541. Pollution abatement surcharges. 15 § 541. Pollution abatement surcharges. 16 (a) Surcharges imposed.--In order to prevent injury to fish 17 and aquatic life and to protect the comfort and convenience of 18 the public in the use of water resources of this Commonwealth, a
1 pollution abatement surcharge is hereby imposed upon all 2 licenses and permits issued under sections 2701 (relating to 3 resident fishing licenses), 2702 (relating to nonresident and 4 tourist licenses), 2901 (relating to eel chute licenses), 2902 5 (relating to net permits), 2903 (relating to boat and net 6 licenses for boundary lakes), 2904 (relating to permits for 7 protection and management of particular fish), 2905 (relating to 8 permits for fish collecting activities), 2906 (relating to 9 permits for use of explosives), 5104 (relating to fees) and 7309 10 (relating to license fees) as follows: 11 (1) For licenses for which a fee of up to and including 12 $15 is charged, a pollution abatement surcharge of 50¢ shall 13 be collected by the commission. 14 (2) For licenses for which a fee exceeding $15 is 15 charged, a pollution abatement surcharge of $1 shall be 16 collected by the commission. 17 (b) Deposit and allocation of surcharge revenue.--All 18 surcharges collected under subsection (a) shall be deposited 19 into the Fish Fund or the Boat Fund and shall be transferred 20 quarterly into the Land and Water Development Sinking Fund 21 established in section 9 of the act of January 19, 1968 (1967 22 P.L.996, No.443), known as The Land and Water Conservation and 23 Reclamation Act. The surcharge revenues which are deposited into 24 the Land and Water Development Sinking Fund are hereby 25 appropriated to the Department of Environmental Resources to be 26 used only for the prevention, control and elimination of 27 pollution from mine drainage and the restoration of abandoned 28 mine lands. 29 Section 2.
