AN ACT
1 Amending the act of March 10, 1949 (P.L.30, No.14), entitled "An
2 act relating to the public school system, including certain
3 provisions applicable as well to private and parochial
4 schools; amending, revising, consolidating and changing the
5 laws relating thereto," providing for confidentiality of test
6 scores.
7 The General Assembly of the Commonwealth of Pennsylvania
8 hereby enacts as follows:
9 Section 1. The act of March 10, 1949 (P.L.30, No.14), known
10 as the Public School Code of 1949, is amended by adding a
11 section to read:
12 Section 1535. Confidentiality of Test Scores.--The
13 Department of Education shall promulgate regulations to protect
14 the confidentiality of pupil test scores. Such regulations shall
15 provide that:
16 (1) All test scores of a pupil may only be disclosed by a
17 school district to the parents of the pupil, teachers and
18 administrators of the school district who need the scores for
19 internal use for testing or to report academic progress unless
1 parental consent is given for other disclosure.
2 (2) A school district may, in its discretion, release to
3 other persons or entities only test scores that are aggregated
4 at the school or district level.
5 Section 2. This act shall take effect in 60 days.
