AN ACT
Amending the act of April 9, 1929 (P.L.177, No.175), entitled
"An act providing for and reorganizing the conduct of the
executive and administrative work of the Commonwealth by the
Executive Department thereof and the administrative
departments, boards, commissions, and officers thereof,
including the boards of trustees of State Normal Schools, or
Teachers Colleges; abolishing, creating, reorganizing or
authorizing the reorganization of certain administrative
departments, boards, and commissions; defining the powers and
duties of the Governor and other executive and administrative
officers, and of the several administrative departments,
boards, commissions, and officers; fixing the salaries of the
Governor, Lieutenant Governor, and certain other executive
and administrative officers; providing for the appointment of
certain administrative officers, and of all deputies and
other assistants and employes in certain departments, boards,
and commissions; providing for judicial administration; and
prescribing the manner in which the number and compensation
of the deputies and all other assistants and employes of
certain departments, boards and commissions shall be
determined," in judicial administration, further providing
for surcharge and fee and providing for investigation and
prosecution of Internet crimes against children; and
establishing the Internet Crimes Against Children Restricted
Account.
This act shall be referred to as Alicia's Law.
The General Assembly of the Commonwealth of Pennsylvania
hereby enacts as follows:
Section 1. Section 2802-E(a)(2) of the act of April 9, 1929

(P.L.177, No.175), known as The Administrative Code of 1929,
added November 1, 2023 (P.L.154, No.22), is amended to read:
Section 2802-E. Surcharge and fee.
(a) Imposition.--
* * *
(2) The following apply:
(i) In addition to the fees imposed under 42 Pa.C.S.
§ 3733(a.1), a surcharge of $11.25 shall be charged and
collected by a division of the Unified Judicial System.
(ii) The surcharge under this paragraph shall be
deposited [in the Judicial Department Operations
Augmentation Account established under section 1795.1-
E(d) of The Fiscal Code.] as follows:
(A) Amounts collected under subparagraph (i)
which are collected upon a conviction or guilty plea
based on the filing of a traffic citation charging an
offense under 75 Pa.C.S. (relating to vehicles) which
is classified as summary under a State statute or
local ordinance as provided in the Pennsylvania Rules
of Criminal Procedure shall be deposited into the
Prosecution of Internet Crimes Against Children
Restricted Account established under section 2803-
E(c)(1).
(B) The remainder of the amounts collected under
subparagraph (i) shall be deposited into the Judicial
Department Operations Augmentation Account
established under section 1795.1-E(d) of The Fiscal
Code.
(iii) This paragraph shall expire July 31, 2025.

Section 2. The act is amended by adding a section to read:
Section 2803-E. Investigation and prosecution of Internet
crimes against children.
(a) Establishment of task force.--The Attorney General may
establish a task force to investigate and prosecute violations
of 18 Pa.C.S. Ch. 31 (relating to sexual offenses) committed
against individuals under 18 years of age using the Internet. A
task force established under this subsection shall meet the
requirements of 34 U.S.C. § 21114 (relating to duties and
functions of task forces).
(b) Designation of task forces.--No later than 60 days after
the effective date of this subsection and each January 1
thereafter, the Attorney General shall designate all task forces
in this Commonwealth that meet the requirements of 34 U.S.C. §
21114, including a task force established under subsection (a).
The Attorney General shall transmit notice of the list of the
task force designations under this section to the Legislative
Reference Bureau for publication in the next available issue of
the Pennsylvania Bulletin.
(c) Funding.--
(1) The Internet Crimes Against Children Restricted
Account is established as a restricted account in the General
Fund.
(2) Money in the Internet Crimes Against Children
Restricted Account may only be used to provide grants and
financial support for task forces designated under subsection
(b).
(3) Money in the Internet Crimes Against Children
Restricted Account may only be used upon appropriation by the
General Assembly.
