AN ACT

Amending Title 30 (Fish) of the Pennsylvania Consolidated

Statutes, further providing for stocked waters open for

3

fishing and for misuse of property and waters.

The General Assembly of the Commonwealth of Pennsylvania

5

hereby enacts as follows:

6

Section 1.  Sections 2103(a) and 2501(a)(7) and (b)(3) of

7

Title 30 of the Pennsylvania Consolidated Statutes are amended

8

to read:

§ 2103.  Stocked waters open for fishing.

10

(a)  General rule.--[Any] The following shall apply:

11

(1)  Except as provided under paragraph (2), any water

12

area in this Commonwealth stocked with fish furnished by the

13

commission shall be open to the public for the purpose of

14

free lawful fishing.

15

(2)  This section shall not apply in and along

16

nonnavigable waters if an owner or other person in control of

17

the area posts signs prohibiting trespassing.

§ 2501.  Misuse of property and waters.

(a)  General rule.--It is unlawful for any person to commit

3

any of the following acts in or along any waters or lands

4

adjacent to or contiguous to waters within or bordering on this

5

Commonwealth:

(7)  Refuse to [identify himself upon request to the

8

owner or the lessee of the land or waters upon which he is

9

present.] provide positive identification upon request of any

10

of the following:

(i)  The owner or lessee of the land or waters upon

12

which he is present.

13

(ii)  A member of the family or an employee of the

14

owner or lessee under subparagraph (i).

(b)  Penalty.--

(3)  Any person convicted of violations under paragraph

18

(1) [or], (2) or (7) may, in addition to any penalty imposed,

19

have his fishing license revoked for a period of one year.

20

Section 2.  This act shall take effect in 60 days.
