                                     AN ACT

     1  Amending Title 42 (Judiciary and Judicial Procedure) of the
     2     Pennsylvania Consolidated Statutes, providing mandatory
     3     sentences for the possession or use of a firearm while
     4     committing a crime.

     5     The General Assembly of the Commonwealth of Pennsylvania
     6  hereby enacts as follows:
     7     Section 1.  Title 42, act of November 25, 1970 (P.L.707,
     8  No.230), known as the Pennsylvania Consolidated Statutes, is
     9  amended by adding a section to read:
    10  § 9763.  Mandatory sentences.
    11     (a)  Possession of firearm.--A person convicted of any crime
    12  during which he was in the possession of a firearm shall serve a
    13  mandatory minimum term of one year of confinement.
    14     (b)  Use of firearm.--A person convicted of any crime during
    15  which he discharged a firearm shall serve a mandatory minimum
    16  term of two years of confinement.
    17     (c)  Definition.--As used in this section "crime" means


     1  murder or any felony or misdemeanor.
     2     Section 2.  This act shall take effect immediately and shall
     3  apply to crimes committed on and after the date of final
     4  enactment.
