                                     AN ACT

     1  Amending Title 53 (Municipalities Generally) of the Pennsylvania
     2     Consolidated Statutes, further providing for parking
     3     authorities in cities of the first class.

     4     The General Assembly of the Commonwealth of Pennsylvania
     5  hereby enacts as follows:
     6     Section 1.  Section 5508.1(e)(1), (f)(2) and (3) and (g) of
     7  Title 53 of the Pennsylvania Consolidated Statutes are amended
     8  to read:
     9  § 5508.1.  Special provisions for authorities in cities of the
    10             first class.
    11     * * *
    12     (e)  Appointment.--
    13         (1)  The Governor shall appoint six additional members of
    14     the board. A member appointed under this paragraph must not
    15     be an elected or appointed officer of the Commonwealth or a
    16     political subdivision.

    18     (f)  Terms.--

     2         (2)  Subsequent to the initial terms, the terms of the
     3     members shall be staggered. For terms beginning June 1, 2002:
     4             (i)  members appointed from the list of nominees
     5         prepared by the President pro tempore of the Senate shall
     6         serve [eight-year] terms ending [June 1, 2010] January 1,
     7         2008;
     8             (ii)  members appointed from the list of nominees
     9         prepared by the Speaker of the House of Representatives
    10         shall serve [nine-year] terms ending [June 1, 2011]
    11         January 1, 2008; and
    12             (iii)  members appointed by the Governor at his own
    13         discretion shall serve [ten-year] terms ending [June 1,
    14         2012] January 1, 2008.
    15         (3)  After the initial terms under paragraph (2), the
    16     Governor shall, [not sooner than 60 days nor later than 30
    17     days] prior to [June 1] January 1 in each year in which
    18     vacancies are due to occur, appoint members of the board for
    19     terms of [ten] five years to succeed the members whose terms
    20     expire on the first day of [June] January next succeeding in
    21     accordance with the appointment procedures provided in
    22     subsection (e). If the vacancies are for members selected
    23     from a list submitted by a legislative presiding officer, the
    24     Governor shall request a list of nominees from that officer
    25     [not later than 90 days] prior to the date the vacancies are
    26     scheduled to occur.
    27     (g)  Removal.--
    28         (1)  Except as authorized in this subsection, no board
    29     member may be removed from office during a term.
    30         (2)  The Governor may, upon clear and convincing evidence

     1     of misfeasance or malfeasance in office, remove a board
     2     member prior to the expiration of the term. The Governor
     3     shall then provide the board member so removed with a written
     4     statement of the reasons for removal.
     5         (3)  The board may, by majority vote, remove a member.

     7     Section 2.  This act shall take effect immediately.
