                                     AN ACT

     1  Amending Title 42 (Judiciary and Judicial Procedure) of the
     2     Pennsylvania Consolidated Statutes, providing for political
     3     activity of district justices, candidates for the office of
     4     district justice and their spouses.

     5     The General Assembly of the Commonwealth of Pennsylvania
     6  hereby enacts as follows:
     7     Section 1.  Title 42 of the Pennsylvania Consolidated
     8  Statutes is amended by adding a section to read:
     9  § 3308.  Political activity.
    10     (a)  General rule.--A district justice or the spouse of a
    11  district justice or a candidate or the spouse of a candidate for
    12  the office of district justice shall not:
    13         (1)  Hold office in a political party or political
    14     organization or publicly endorse candidates for political
    15     office.
    16         (2)  Engage in partisan political activity, deliver
    17     political speeches, make or solicit political contributions
    18     or attend political or party conventions or gatherings,
    19     except as authorized under subsection (b). Nothing in this

     1     section shall prevent a district justice or a candidate for
     2     the office of district justice from making political
     3     contributions to a campaign of a member of his immediate
     4     family.
     5     (b)  Exception.--A district justice or the spouse of a
     6  district justice or a candidate or the spouse of a candidate for
     7  the office of district justice may, in the year the district
     8  justice or candidate runs for office:
     9         (1)  Attend political or party conventions or gatherings.
    10         (2)  Speak to political or party conventions or
    11     gatherings on his own behalf or on behalf of his spouse.
    12         (3)  Identify himself or his spouse as a member of a
    13     political party.
    14         (4)  Contribute to his own campaign or to the campaign of
    15     his spouse or to a political party or organization.
    16     Section 2.  This act shall take effect in 60 days.
